Independent Inquiry into Recent Clashes and Procedural Reform on Evidence Collection Urgently Required as Sexual Crime Victims' Confidence in Reporting Plummets

Ended on September 30, the Anti-ELAB' Sexual Violence Experience Online Survey contains a total of 67 respondents who reported having experienced sexual violence in Hong Kong.

The following is excerpted from the Executive Summary released by The Association Concerning Sexual Violence Against Women (Rainlily) on Nov 6:

//the problem of sexual violence is common yet very serious during the 'Anti-ELAB' movement. A wide range of sexual violent acts are encompassed in respondents' narratives, from verbal abuse to threat and intimidation, from sexual assault to unlawful intercourse.

Even worse is the very low reporting rate, through which nearly all but two respondents declined to contact the police or other legal enforcement agencies for assistance. The result does not only points to the failure of the law enforcement agencies in serving its expected social purposes (e.g. erosion of public confidence and incapable to handle victim-survivors' needs), but meanwhile, it also implies that the lack of a mandated independent mechanism, for which to receive and investigate complaints, would foster an atmosphere of fear and violence, dangerously undermining social stability and harmony.//

Student Disclosed Police Sexual Assault Refused to be Silence Despite Threats

Sonia Ng, a Chinese University student who accused police of sexual assault, refused to obtain bail in her arrest for unlawful assembly on Aug 31 at Prince Edward Station. Ng condemned the police's arbitrary arrest and their intent to silence by intimidating and even assaulting protestors during detention.

Ng said this would not deter her from speaking up. Ng also wrote an open letter to Carrie Lam calling for independent inquiry into the Hong Kong police' power abuse and sexual violence towards arrested protestors. Carrie Lam has until December 31 to respond to the letter openly.

Hong Kong Police Threaten Proresters with Rape and Gangrape

In addition to physical violence, many defendants complained in court about police’s intimidation, abusive behaviours and threat of personal safety of their own self, their families and partners.

At least two female defendants complained that police officers have threatened to rape her; and a male defendant complained of police’s threat of gangrape.

⁃ 2 Sep 2019: 3 people were charged of damaging Yau Tong MTR station facility. During the arrest, police threatened them to submit their mobile phones and password, and said: “The police dog has not eaten any breakfast, they might bite you if you don't shut up!”.

⁃ 1 Oct 2019: During the Wong Tai Sin conflict, 15 people were charged for rioting. Police threatened them and said: “Continue coming out for protest, I will bring my guns after duty, shoot one kill onr!”

⁃ 18 Nov 2019: During the seige in PolyU, many people tried to surround the university to help those trapped to leave the campus. A 19-year-old female was threatened by male officers in police station: “Have you ever been raped by anyone? The room outside is the “Rape Room”, don’t you believe that?”; another 16-year-old male student complained a masked unidentified officer from Special Tactical Squad who said: “You will be brought to San Uk Ling Holding Centre for gangrape!”

⁃ 12 Nov 2019: During a strike, a female student was charged of possession of offensive weapon. After being carried to the police car, a police officer said: “Don’t you believe that I will rape you?”; anther two officers slapped her and insulted her as “slut”.

⁃ 2020: 3 people were charged under another bomb incident. A 25-year-old male and his girlfriend were arrested. Police officers threatened him to admit his crime and said: “I will get your girlfriend in trouble”, “Other people were hit badly, do you want to try?”

⁃ 16 Jan 2020: A 29-year-old male defendant of the bomb incident in Sheung Shui was arrested, together with his family and maid. Police conducted home search for two separated days and arrested his wife, mother and maid, without any notification in advance. For statement taking, police declined accompany from the lawyer and threatened the defendant: “If you do not admit your crime, I will kill your wife and mother.”

Police Storm in Female Public Toilet and Remove Civilians from Leisure Park

The police conducted a series of flanking operations in Mongkok, even entering the female public toilet in Sai Yee Street Park.

Reporters asked two homeless persons around the public toilet if they witnessed what the police did at the female public toilet. They said they heard multiple screams and exclamations of pain.

During the time, the police also swept the elderly and minorities away from the park.

Police rough up a woman, then flee the scene

As Special Tactics Squad (Raptor) officers charged past a bus stop on Nathan Road in Mongkok at around 10pm, several of them grabbed a middle-aged woman by her head and began shoving her around.

They only let her go after several bystanders began calling them out: "Raptors are beating up a woman!"

The police left without detaining the woman or laying charges. The reason of their assaulting of the woman remained unknown.

May 10 is Mother's Day.

Victim of Sexual Violence by the Police Urges Hongkongers to Speak Up Against Injustice

A press conference was held at the headquarters of The Hong Kong Social Workers' General Union on June 22, 2020. An underaged female student, K, spoke of her experiences of the police's verbal and sexual abuse after her arrest on September 25, 2019.

After K was arrested in a shopping mall, several police officers insulted her with profanity that demeant women and a female officer "grabbed" her breast several times. K was appalled by the police behaviour even in the public. She then heard that she was dehumanized into a "piece" in a conversation between the police.

At the police station, K's request to the bathroom was repeatedly denied. K told the police that she has human rights. This triggered a series of insult from the police: A female officer said to her, "Human rights are based on freedom, but you are a criminal. Here, we have a say in your freedom. You'd better keep quiet," while a male police officer mocked K by saying "I have human rights!"

K was finally allowed to go to the bathroom but only one hour later. At the toilet, she was directly gazed at by a female officer. K requested her privacy to be respected, but the officer claimed it was part of the protocol.

K requested to call her lawyer and family for at least 6 times but was never granted. Even worse, K had to face a third-degree body search, which required to have all her clothes removed. During the search, a female officer leant very close to K's chest and private parts while humiliating her with insults.

K was brought back to her home for a search by a male police officer, but without the company of her family or lawyer. K felt completely terrified during the search.

After all these happenings, K was traumatized and made three attempts to commit suicide including jumping into the rails. K was diagnosed with PTSD. Nonetheless, she chose to speak up to let other victims of police violence know that they were not alone and they should not blame themselves as they had done nothing wrong.

K wanted to send a message to all Hongkongers that one should speak up when facing injustice.

While K will face a trial in Shatin Magistrates Courts at 14:30 on July 21, the Hong Kong Social Workers' General Union is launching an official complaint to the police about the case.

Founder of Taiwanese Forum PTT Boycotts Disney's Mulan, Hailing Hong Kong Women as "True Mulans"

Ethan Tu, founder of Taiwan’s AL Lab initiative and forum PTT, announced on 6 September, 2020 that he will resolutely boycott Disney's Mulan starred by Chinese actress Liu Yifei.

Tu pointed out that the true spirit of the heroic Mulan is carried by many women in Hong Kong who took to the streets to defend their homeland, the rule of law and human rights even though they were threatened by police violence.

In Tu's opinion, Chinese actress Liu Yifei, who was openly supportive of the infamously abusive Hong Kong police, was too hypocritical and therefore incapable of portraying the heroine Mulan.

"I will not watch Mulan. For I have watched the real Mulans [in Hong Kong] die for my ideals and freedom for a whole year. I cannot watch the hypocritical patriotic story of becoming a hero."

Tu lamented that the youth took to the streets for Hong Kong, but were threatened and persecuted by the Hong Kong police with sexual violence. Therefore, he could not look at Liu Yifei, who supported Hong Kong Police's indiscriminate violence.

Special thanks to our sister for reminding Hongkongers to stay angry against the corrupted cops. We keep hearing this kind of sexual abuse time after time!

The content of the letter is as follows. [Note: younger protestors sometimes call older protesters “parents”]

Dear Parents and the Hong Kong Book of Freedom,

I am so sorry. Even after you have paid my tuition fees, I still decided to flee. As I was arrested by the police at the Hong Kong Polytechnic University (PolyU) during the protest on 1 October 2019, I now have no choice but to leave. My dear parents, I am so sorry to have wasted your well-intended efforts and kindness. I will pay it back after settling down in my new surroundings. But I want to mention one last thing. While I was under police custody, several police officers touched my breasts and even brazenly commented about how “it felt great”. This took place at a car park about 10 minutes’ walk from the location I was arrested in Tsuen Wan. My head was covered in a black cloth at the time and I dared not make any sound. I am sorry. While I am reluctant to mention it again, I believe there are more victims. I hope other Hongkongers can avenge for me. May glory be to Hong Kong.
