Macau leader Ho Iat Seng’s tactics: 4 lessons for Carrie Lam

1. Apparently, Macau’s immigration control is less tight than Hong Kong’s as it doesn’t forbid the entering of Hubei people who can provide medical proof. Yet, on a practical level, the Macau government states that no doctor, at the present stage, can produce valid medical proof that confirms that a person “is not” a carrier of the Wuhan coronavirus. The result is the same, but Macau has clearly made a better gesture to the PRC.

2. The advantages of using this method are that it fits the aim to forbid the entering of Hubei people without losing all the flexibility, and it can also test the limits of Beijing. As long as Beijing doesn’t complain about it (right now, the Liaison Office of the Central People's Government and the Hong Kong and Macau Affairs Office are dealing with their own problems, they will not be able to give clear direction other than empty statements like “do anything that will benefit the fighting of the disease”), Macau can use the same method in the future to restrict the entry of other Mainlanders. Whereas in Hong Kong, as our government publicly states that it needs to “take care of the feelings of Mainland China”, any further closing of borders will turn into a political problem, which puts the government in a bind.

3. By forcing the Hubei people out of Macau, not only can the Macau government keep the epidemic under control, it also sends a clear signal that all entries and exits are under its control. When this message is spread on Weibo, Mainlanders are shocked, for they realise that Macau doesn’t need to “care about the feelings of the Mainland”. As a result, it minimizes their desire to go to Macau, but at the same time, the Macau government doesn’t have to make it publicly known. Whereas in Hong Kong, our government welcomes Mainlanders to arrive and use the free medical service, saying repeatedly that we concern the feelings of the Mainland. Of course the target audience will understand the meaning behind.

4. Macau uses the police to “help” the Hubei people to leave. This approach not only shows that the government is “strong”, it also allows the police to play a positive role to gain internal support. It shows a great contrast to the image of Hong Kong police in the past 7 months, giving credit to the principle of “One Country, Two Systems”, and diffusing the charge of police brutality prevailed in Hong Kong. Beijing will be glad to see. Yet, the Hong Kong police have been flattered to become “the heroes that stop violence and chaos”, “People of the Year” on Weibo, if they suddenly have to act the role of “traitor” that expels Mainlanders, the show cannot go on. Macau grasps this opportunity quickly, and for sure does much better than Hong Kong.

“One Country, Two Systems” is a big gamble. Carrie Lam thought that handling the crises by power will be the solution. It turns out to be the very culprit of ruining “One Country, Two Systems”. Look at the extradition bill, look at the epidemic, she’s hopeless.

The downgrading of Hong Kong's credit rating fron Aa3 from Aa2 is one of the response from investors towards the government's failure to address local concerns, which inadvertantly resulted in a slowdown in the economy.

Recently, the outbreak of the novel coronavirus in China is another trial that the Communist government has been put to face. The quick surge of the number of infected people and deaths show the incompetence of the Communist government. After breaching the pledge of "One Country, Two System", the Communist government is attempting to further reduce Hong Kong to ruins again.

The expulsion of US journalists from Hong Kong and its implications

When the rule of law can no longer be upheld, the demise of Hong Kong is near

Just after midnight (on 18 March), China issued a bombshell statement that sent shockwaves throughout the Hong Kong media. In the statement, the Ministry of Foreign Affairs announced a ban of 13 US journalists from reporting in Hong Kong. From a legal standpoint, articles 27 and 154 of the Basic Law clearly state that Hong Kong residents shall have the freedom of press, and that the Hong Kong SAR government shall have the power to apply immigration controls. Prohibiting these journalists from reporting in Hong Kong is a clear violation of constitutional rights under the principle of “One Country, Two Systems” and a threat to Hong Kong’s autonomy.

Beijing law professor warns: the later national security laws enacted, the greater the price to pay

Even before the dust has settled around the Anti-Extradition Law Amendment Bill (ELAB) movement, the pro-Beijing camp has once again revived the contentious issue of enacting national security laws as constitutionally obligated under Article 23. Rao Geping, former member of the Basic Law Committee and professor at Peking University Law School, described the movement as hindering the progress of “One Country, Two Systems”. He also stated that the longer Hong Kong takes to fully enact national security legislation, the greater the price it would have to pay, and the greater the necessity of direct intervention by the state. He added that it was necessary to improve the mechanism by which China currently administers Hong Kong’s autonomy, which includes the monitoring of whether legislative work violates Basic Law, and regulation of the central government's right to review bills before they are tabled.

The time of "One Country, two system" is dead!

Despite a short-lived protest from the democrats, Pro-Beijing camp's favourite Starry Lee of the DAB party has been elected House Committee Chairperson of the Legislative Council, winning an overwhelming majority of the votes. It is evident that the local legislation and even elections within the legislature have been interfered with by the central government in #Beijing , which keeps ignoring its part of commitment stipulated in the Sino-British Joint Declaration. It is yet another sign of the demise of ‘One Country, Two Systems’.

Chinese officials have announced plans to impose sweeping new controversial laws on Hong Kong after last year's pro-democracy unrest, the implications of which activists say could be "deadly dangerous" and a "knockout blow" to the "one country, two systems" principle.

The controversial National Security Law would ban secession, foreign interference, terrorism and all seditious activities aimed at toppling the central government and any external interference in the former British colony. The Chinese government thinks that it could silence Hongkongers’ voices by force and fear, yet it does trigger their anger to a greater extent. Also, it thinks that Hong Kong could bring them lucrative economic benefits and could be easily controlled as mainland.

However, it doesn't understand that the real causes of Hong Kong's success are Hongkongers' diligence and creativity, the Laissez-Faire policy, and the rule of law. There is close economic relation between Hong Kong and other countries due to its stable economy and successful judiciary system. Thus, international companies trust that Hong Kong is a reliable place to be invested in.

In fact, mainland China used Hong Kong as a springboard to connect the world in the past. However, China's interference with Hong Kong's local affairs has caused Hong Kong economic growth dropped sharply, as such global companies have been starting to quit the market of Hong Kong since the city’s #freedom and high degree of #autonomy are being eroded.

Although Hongkongers are facing creeping meddling brought from authoritarianism, Hongkongers will not give up. It is because Hongkongers receive supports from all over the world and they know that they are not left behind.

“I don’t know what it is, because nobody knows yet. If it happens, we’ll address that issue very strongly”, said Donald Trump. “We demand the Canadian government and the international community to immediately revoke Hong Kong’s special administrative status. We must consider Hong Kong’s democratic future outside of the confines of the One-China fantasy”, Alliance Canada Hong Kong states.

Therefore, we Hongkongers are not afraid of the #tyranny. We keep fighting against the unfair system and fighting for what we deserved -freedom. The resilience of #Hongkongers shall not be underestimated because we are water. We shall not stop our protests and revolution - not until we win.

China lost patience over Hong Kong

The central government is exploiting the right of Hong Kongers at an alarming rate, interferencing local legislation and “the high degree of autonomy”. Chinese officials have announced plans to impose controversial laws in Hong Kong, the implications of which activists say could be "deadly dangerous" and a "knockout blow" for Hong Kong's one country, two systems deal with China.

Hong Kong’s autonomy was guaranteed under the “one country, two systems” principle enshrined in the 1984 Sino-British joint declaration. Yet, 186 law and policy leaders from UK said the proposed laws are a “comprehensive assault on the city’s autonomy, rule of law and fundamental freedoms” and “flagrant breach” of the Sino-British Joint Declaration. Despite being blamed for the pandemic, China is using the coronavirus crisis as a distraction to push through its geopolitical aims. The international community should not trust Beijing to keep its word when it comes to Hong Kong, people will be reluctant to take its word on other matters. The only hope of Hong Kongers might be from international helps, especially, Britain's.
Chris Patten, the last governor of the former British colony, mentioned China has betrayed the people of Hong Kong, and the UK has a moral, economic and legal duty to stand up for them. He also suggested Hong Kong residents with British national (overseas) passports (BNO) should be allowed to settle in the UK. The number of applications of #BNO has increased sharply since 2019. Hong Kongers have no faith in the #tyranny government.

Boris Johnson’s spokesman said on Friday that the prime minister and his government were monitoring the situation, and that as a party to the joint declaration the #UK was committed to the upholding Hong Kong’s #autonomy and respecting the one country, two systems model. And that could be the only hope for Hong Kongers to shirk the authoritarianism. Yet, even #immigration can help some of the Hong Kongers, the root cause has not been solved. As a Hong Konger, I wish that Britain could take a part in our situation as what Chris Patten mentioned and willing to give a hand to us.

The National security law: the “Second handover” in the eyes of China, and the twenty steps

Many were surprised to see Beijing directly inserting a national law ‘The National Security Law’ into the appendix of the Basic Law, given there were already many signs before head. I have written articles warning that such could happen, but was ignored among the many many articles and public opinions. And we must stay calm, think so to strike back afterwards. Beijing didn’t make these move impulsively, but accomplishes them with detailed plans. So they don’t treat it as normal clash, but alleviate it to the level of ‘HK’s Second handover’. A real HKer, must therefore learn these moves, to understand ourselves and our enemy.

1. Beijing believes the pandemic has brought along a good timing to forcefully intrude into HK’s affair. and this is based on the assumption that the West has been affected by the pandemic more severely than herself, and requires more time for economy recovery. So the West will not truly want to decouple with China, and will greatly need Chinese capital and market. Be it on “Wolf diplomacy” (extremely aggressive diplomacy), full and all rounded deployment of soft power, or HK’s national security law, are illustrations of pragmatism and brinksmanship. Just like the reclamation and making of island on the South sea. No matter how the world condemned the act, the world didn’t take action, so the island was made there.

2. Beijing as the biggest winner of the last 20 years of globalisation, also becomes one of those on the same boat. Although she understands anti China is becoming a trend, the existing elites and their friends around the world will still be in power for 10 years or so. This group is easily drawn in, for they care about their personal interests. So even policies like ‘Sinophile making great money’ will emerge. Before the new and ideology-guided generations taking the office, this gap is the final opportunity for China to implement her strategy.

3. Beijing believes all the commerce associations only care about profit, and are only worried about themselves, who have connections with ‘foreign associations’, being extorted under the national security law. So Beijing only needs to win them over by procurement contracts and deals, the businessmen will deploy their influence to lobby within their countries. Examples include the businessmen who betrayed and sold HK away in the 90s.

4. Internationally, UK has the most right to express her opinion, but since Beijing is in the impression that the UK, having less influence than before, will not take action in fight between China and US, or take side to provide mandate to other countries, such as taking legal action against Chinese’s unilateral violation on the joint declaration. China has moved its enterprises away from US, and even suggested enterprises to go public in the UK, so to tackle each nation. Trump is hostile against his allies, and advocates unilateralism. So Beijing guessed that the West would not let US do everything as she wishes.

5. US’s response can be diverse. In addition, the election in Nov is coming soon, many class of politicians will play the anti China card, but as they only targets on votes, they might do something totally opposite. CCP, based on their understanding on humanity, thinks that US at most will sanction a few second class officials (such as Xinjiang CCP secretary Chen Qhuanguo) and CCP could just comfort the related parties with their power. But when it comes to rejecting HK’s status as separate custom territory, and more so financial wars, CCP believes the politicians will not act at the expense of their own.

Impact of National Security Law

(25 May) As a matter of fact, the Chinese Communist Party's (CCP) National Security has been secretly operating in Hong Kong. In 2016, the United States issued a human rights report that Paul Lee's disappearance was suspected to be related to national security, which was quickly denied by the Hong Kong government by saying that "law enforcement agencies outside Hong Kong have no authority to enforce the law in Hong Kong", indicating that they also knew that the truth could not be revealed. The abduction of businessman Xiao Jian-hua at the Four Seasons Hotel in 2017 also caused a stir for a while. Chairman of Bar Association Calls City’s National Security Law “Reverse Engineering” of Extradition Bill

The Deputy Director of Hong Kong and Macao Affairs Office of the State Council, Den Chung-hua claimed on Monday (June 15) that the SAR government holds the “primary responsibility” to safeguard national security in Hong Kong, accountable for law enforcement and judiciary issues. However, in the event of an “extremely special” incident, the China state government will retain jurisdiction over the case.

In an interview, Philip Dyes, Chairman of Bar Association stated that the Chinese state government is attempting to take control of serious cases tempering national security in Hong Kong, in such a way that he described as a “reverse engineering of the extradition bill”.

Dyes explained that, “Rather than you going to the mainland, the mainland comes to you.” He carried on criticizing that there are still no concrete details in the National Security Law. But for now, it appears to be a weird hybrid of common law and civil law.
