Perhaps the Last Remaining Freedom of Speech: HongKongers Buy Out Apple Daily Newspaper at 3am

To show support for #NextMedia and #AppleDaily, many HongKongers said they would still purchase a copy of the newspaper even if it is blank.

At 2am, many people went to Mongkok to look for the latest copy of the newspaper. This is one day after the newspaper's headquarters had been raided by 200 police and its founder Jimmy Lai, his two sons and 4 other management executives had been arrested.

A 26-year-old man bought 50 copies to give out to his colleagues, family, neighbors and friends and to share the last remaining moment of free speech.

Reporters on the scene were also buying a copy for themselves. Before 3am, Apple Daily was sold out in many stalls in Mongkok.

In addition to the personnels related to Apple Daily, police arrested former #Demosisto member #AgnesChow, former #Scholarism member #LeeChongChak and
"#HongKongStory" member #LeeYuHin on the same day.

Barrister Lawrence Lau: "Collective Punishment: We All Could Be Jimmy Lai"

//The day has finally come. Next Digital's Jimmy Lai was arrested for "colluding with foreign powers" - if he hadn't broken any laws before, they have now made one up for him. Ever since the National Security Law was passed on July 1, Lai was asked again and again whether he would leave the city. Again and again he said no; he would walk with Hongkongers, because Hong Kong is his home.

In this new age of One Country One System, what does "colluding with foreign powers" even include? Holding a conference with foreign academics? Using American eggs in your restaurant? There are no clear answers. What counts as "colluding with foreign powers" is entirely up to those up there, and them alone; it's collusion if they say so. This is the absurdity of the National Security Law: it runs completely contrary to what the modern world expects from the rule of law, that is, the letters of the law must clearly spell out its intents and requirements to the public, so that people can take care not to break it.

Two hundred Blue Berets marching into Apple Daily's offices seemed like a scene straight out of history movies, from Korea's Gwangju Uprising 40 years ago. In 1980, the military government stormed into a newspaper office and made indiscriminate arrests, trying to silence the news of their violent crackdown on the city. After the gunfire ceased, the government thought they had finally secured Gwangju for themselves; what they never imagined was that it spurred thousands of angry citizens onto the streets, ultimately leading to the democratization of Korea.

40 years later, we live in an age where information flows hundreds of times faster than in Gwangju, yet this totalitarian government is still trying to crack down on press freedom and stifle information flow in an attempt to keep us from the truth. Either they are stupid, or they no longer fear the consequences of their actions! If that is the case, then neither should they fear international sanctions. The treacherous acts of the Hong Kong Communists and evil police force have long been in plain sight of the international community. Government officials would be wise start buying plane tickets for their children studying abroad; just like Carrie Lam's son, they better hurry back to Hong Kong, and bask in the glory of China's Greater Bay Area - for the rest of their lives!//

Bailed Out After 30-hour Detention
Next Media CEO Cheung Kim Hung: "I'll Proceed Despite the Hardships, My Passion Burns Despite the Weariness"

CEO of Next Digital Limited and Apple Daily Cheung Kim Hung was detained for about thirty hours before being released on bail at Sau Mau Ping Police Station on Tuesday night (11 August).

Cheung stated that "justice will prevail", and that he could "handle this" and would strive to do better. He also cited from the New Asia College anthem, "I'll proceed despite the hardships, my passion burns despite the weariness" (艱險我奮進,困乏我多情), thanking Hong Kongers for defending Apple Daily with herculean effort.

According to sources, Cheung was arrested for "conspiracy to defraud". When asked whether he would be charged with crimes related to the National Security Law, Cheung stated that it was unlikely.

Editor's Note: Ch'ien Mu, lyricist for the anthem of New Asia College, fled the Chinese Communist Party at October 1949 and founded New Asia College. Despite being in financial stress, he, along with other famous New Confucianism Scholars at the time, strove to establish Chinese higher education in Hong Kong as well as promoting Chinese culture. Ch'ien had thought that with New Asia College's merge into the then-new Chinese University of Hong Kong, it would be unable to promote Chinese culture and use Chinese in teachings, and gave his request to resign to then Chairman Dr Li Choh-ming. He denied his pension (which could be given if he chose to retire) to state his discontent, stating that a resignation is a kind of attitude, while a retirement is only a natural end to his career.

Such is the spirit of New Asia College, putting their principles and conscience above of their personal interests.

Wall Street Journal: "Jimmy Lai, China’s Lie: In today’s Hong Kong, promoting democracy makes you a criminal"

The Wall Street Journal (#WSJ) published an article titled "Jimmy Lai, China's Lie" in the name of the newspaper's editorial board. The article describes how advocating democracy makes one a criminal in Hong Kong.

On Dec 2, 2020, the founder of Apple Daily #JimmyLai and two senior executives of Next Digital were charged by the police with fraud. In the hearing on 3 December, Judge Victor So Wai-tak, whk is an appointed Judge for the National Security Law (#NSL), refused Lai's bail application.

Lai is rejected bail for the first time and will be detained in Lai Chi Kok Reception Centre until the trial to take place on April 16, 2021.

"No one is better known across the world for advocating democracy in Hong Kong than Jimmy Lai. So when Hong Kong police picked him up Wednesday on dubious fraud charges, China was sending a clear message: If you oppose us anywhere in the world, we will crush you" wrote WSJ.

"However, the fraud charge is not as serious as some of the others he already faces, especially on national security, its purpose is to dirty him up before he goes to trial on the others."

The WSJ article also mentioned it is no coincidence Joshua Wong, Agnes Chow and Ivan Lam were sentenced to prison for participating in 2019 protests against a proposed extradition law on the same day. House Speaker Nancy Pelosi rightly denounced the sentences as "appalling."

WSJ believes that Beijing is testing the position of Joe Biden, who is on board as the new U.S. President next month, to see if he will be different from Trump Administration.

The article supports the U.S. to consider adding more Chinese officials in the sanctions list and review Hong Kong's legal system. It emphasizes the U.S. has to refuse to accept "Chinese Community Party's (#CCP) Lie".

The article wrote, "We trust Joe Biden is paying attention." However, Biden is not eager to get trouble with China. But Chinese leader Xi Jinping has his own priorities.

WSJ described, "He [Xi] is testing whether a Biden Administration—especially one seeking a climate accord—will look the other way on China's behavior in Hong Kong and elsewhere."

WSJ urges for sanctioninh more Hong Kong officials, following how the Trump administration has voiced for Hong Kong and sanctioned Chief Executive Carrie Lam and ten senior officials in Lam's team since the Hong Kong Autonomy Act effective in August.

WSJ also hopes the U.S. to consider adding more officials the list and evaluate Hong Kong's legal system.

WSJ continues, "If lease disputes can be criminalized to go after political opponents, perhaps the government should advise U.S. courts that contracts in Hong Kong should no longer be presumed reliable. The sooner Mr. Biden makes clear these and other moves enjoy bipartisan support, the better he will be in his own coming dealings with China."

At last, the article believes that "the most powerful message the U.S. can send to China is moral" and quoted Alexander Solzhenitsyn's essay "Live Not By Lies" written in 1974 that "the best way to resist was to refuse to participate in the everyday lies all Communist regimes depend on."

"With regard to Xi Jinping, China's lies is about everything from the origins of the coronavirus to his incarceration of more than a million Uighurs.
China is now claiming that Jimmy Lai, Joshua Wong, Agnes Chow and Ivan Lam are criminals for taking a stand for democracy. Insisting on the truth may not immediately set them free. But the lack of moral credibility is the regime's biggest vulnerability, and refusing to accept its lies must be the starting point of any U.S. China policy."

International attention on HK top court's decision to revoke Jimmy Lai's bail release, calling for justice and immediate release

Hong Kong media tycoon and pro-democracy activist #JimmyLai has been sent back to jail after the territory’s top court rescinded his bail on new year's eve. The decision came just days after People’s Daily, the Chinese Communist party mouthpiece, lambasted the decision to grant bail and raised the spectre of his case being transferred to China.

Benedict Rogers, founder of Hong Kong Watch, a UK-based campaign group, condemned the court’s decision. “Judicial independence trampled on, the rule of law further undermined, and yet another outrageous assault on #HongKongers,” he wrote on Twitter.

Another member of Hong Kong Watch, Luke de Pulford also criticised, "In a totalitarian state, if justice isn't the justice you expected, just try again."

Senior fellow at the University of Nottingham Asia Research Institute Andreas Fulda condemned the Hong Kong Government's approach as "rule by law" rather than the rule of law and called for immediate release of Jimmy Lai.

Member of the Finnish Green Part, Eero Kivistö, rallied a demonstration at the the Chinese Embassy in Finland urging for release of Jimmy Lai and the 12 youth being arrested for attempting to flee the city.

Member of the International Commission on Religious Freedom, part of the Federal Government of the United States, Johnnie Moore pointed out that Jimmy Lai’s case showed further distortion of Hong Kong’s judiciary system.

Republican congressman from Colorado Ken Buck, retweeted Jimmy Lai's news with the hashtag #freeJimmyLai.

Japanese Media Headlines: "Waiting for my friends and Apple Daily to return"

[Editor's note: Kinya Fujimoto, deputy editor of the Sankei Shimbun, is the co-winner of the 2020 Vaughn-Uyeda Memorial Prize in Journalism]

Japanese newspaper #SankeiShimbun covered the shutdown of Hongkong's pro-democracy newspaper #AppleDaily extensively.

On the front page of the newspaper on June 24, 2021, the headlining news article was about Apple Daily and was accompanied by a column titled "Waiting for my friends and Apple Daily to return" in Chinese, penned by #KinyaFujimoto, an award-winning journalist.

The article states that Apple Daily was the only newspaper in Hong Kong that criticized the #CCP. The authorities' suppression of the newspaper leads to its suspension and indicates the loss of press freedom in Hong Kong.

The article also tells the story of #JimmyLai, the founder of #NextMedia. Lai escaped from China to Hong Kong and establish the pro-democracy Apple Daily in 1995.

Journalist Kinya Fujimoto recounted how he met with editor-in-chief #RyanLaw for the first time in June 2021. At the time, Law mentioned the difficulties to obtain a journalist visa in China and the CCP's ban from interviewing senior officials in the Chinese government. Fujimoto replied that Sankei experienced the same, then the two smiled bitterly.

Next to the Fujimoto's article, the main news article was published entitled under the headline "Hong Kong's Apple Daily Discontinues".

Kinya Fujimoto pointed out that the newspaper did not describe Apple Daily as an "obsolete", but a "discontinued publication". He believes, "after going through the dark age, the newspaper Apple Daily would be the one announcing Hong Kong's retribution."

Fujimoto wrote, "Apple fell, but I believe that is not the 'final chapter'".

#PublicLibrary Chief in Hong Kong is Subject to Discipline after Displaying #JimmyLai's Books

Under the National Security Law, civil servants and non-civil servants in Hong Kong are required to sign a "declaration" upholding the Basic Law, "devoting" themselves to the HKSAR, being "loyal" to their work and being accountable to the HKSAR government.

As of September 2021, around 180,000 civil servants have signed the declaration, only 129 have not responded or refuse to sign. Among them, 105 are in long-term employment terms, and the rest are in trial-term employment terms. 113 out of them are in civilian grade, and the rest are in discipline service grade.

Patrick Nip Tak-Kuen, Secretary for Civil Service in the Hong Kong SAR Government attended a Legislative Council (#LegCo) meeting on September 20, 2021.

When answering a question about the penalty for civil servants violating the declaration, Nip revealed that the government had already started the discipline procedure towards a public library chief.

The related librarian is the Director of #ShekTongTsui Public Library. He was suspended from his duty, after placing a number of books authored by Jimmy Lai, the founder of #NextMedia and #AppleDaily, in the "Librarian's Choice for Borrowing". Apple Daily was a pro-democracy Chinese-language newspaper in Hong Kong, which had to shut down due to the government's pressure in June 2021.

The Last Day of #StandNews: Hongkongers' Professionalism and Perseverance

Stand News, an independent news outlet in Hong Kong, was founded in December 2014, and it has come to an end after seven years.

Two years ago in 2019, Hong Kong was caught up in the historic #AntiELAB movement. Stand News provided live streams on the frontlines in various districts, narrating the latest situation live, recording the city's most tumultuous moments. Their efforts made Stand News stand out from the numerous news media platforms.

In June 2021, the National Security Bureau arrested senior personnel from #NextMedia, forcing the shut down of #AppleDaily and leading to the closure of a number of publications. Stand News became the largest open, pro-democracy online news website in Hong Kong.

However, the #HKSAR government singled out Stand News on numerous occasions this year, accusing the company for "misleading" reporting of the CUHK clashes and smart prisons.

Finally on December 29, 2021, after a number of current and former seniors were arrested and the company's assets frozen, Stand News announces to cease operation and to dismiss its entire staff.

Staff members returned to the Stand News office in the afternoon, one after another. By the evening, many of them are still in the office, and rounds of applause are occasionally heard. They also took photographs with the journalists waiting outside the office, recording of their moment in history: "I have fought a good fight."

Stand News suspends its website, Facebook page, Youtube channel, and Twitter and Instagram accounts at 11pm on December 29. All content has been removed.

British lawyers defending Hong Kong pro-democracy tycoon Jimmy Lai say they have received threats

//Barristers from a British law firm who are representing jailed Hong Kong tycoon and democracy campaigner #JimmyLai said on July 7, 2022 they had received anonymous e-mails warning them against travelling to the city to defend him.

Lai is among the most prominent people in Hong Kong to be charged under a #National SecurityLaw that Beijing imposed in June 2020 to punish terrorism, collusion with foreign forces, subversion and secession with possible life imprisonment.

The barristers - Caoilfhionn Gallagher, Jonathan Price and Jennifer Robinson from Doughty Street Chambers - told Reuters the messages came from a generic Gmail address.

"A person that refuses to abide by the laws of the Hong Kong Special Administrative Region could be extradited...from other jurisdictions. Foreign nationals will be charged with the offences of subversion," one of the e-mails said. "You have been warned not to attempt entry or land in Chinese territory."

The barristers declined to say if they would be travelling to Hong Kong for the trial.

"Threatening journalists, campaigners and lawyers within Hong Kong has been happening for some time," the barristers said in an e-mail.

"Now these intimidatory tactics are spreading outside the borders of China and Hong Kong."

Police said in a statement they were concerned about the media reports and "strongly condemn the act of impersonating police officers". They appealed to those concerned to provide further information.

The government did not immediately respond to a request for comment on whether the barristers would be allowed to enter Hong Kong.

Baroness Helena Kennedy, Director of the International Bar Association's Institute of Fundamental Rights, condemned what she said was an act of intimidation.

"Intimidating the lawyers who act for citizens pursuing freedom and democracy is the tactic of an authoritarian regime," she said.

"Jimmy Lai's right to instruct international lawyers of his choice is fundamental to a fair trial. The Hong Kong authorities seem to have abandoned the values which underpin the rule of law."//
