Jimmy Sham Calls On Hongkongers to Fight On: We Will Overcome As Long As We Speak Up

The PRC's National Congress opened on May 22 and announced immediately the expected passage of the National Security Law for Hong Kong but in China on May 28.

On May 22 in Hong Kong, a press conference was convened by Civil Human Right Fronts (CHFR), pro-democracy lawmakers and groups like Hong Kong Alliance in Support of Patriotic Democratic Movements in China.

Jimmy Sham, convener of CHFR who has organized many anti-extradition law protests last year, reminded Hongkongers to use different ways to resist the National Security Law, "As long as we stand up, we will be able to overcome it".

Hong Kong's High Court Upholds Discriminatory Definition Of Marriage, Judge: “I didn’t dare to make the right choice.”

Jimmy Sham, a member of the LGBT+ rights organization Rainbow of Hong Kong and convener of Civil Human Right Front, got married to his male partner in New York in 2013. He lodged for judicial review in Hong Kong in 2018 requesting the High Court to rule the Hong Kong government rejecting oversea same-sex marriage as discriminatory, which is a violation of the “Basic Law”.

In the High Court verdict on Sept 18, 2020, Judge Chow stated that the current statutory definition of marriage in Hong Kong was “one man and one woman” and that therefore Sham's marriage wasn’t legitimate, so the court ruled against him.

Sham said outside the court that the Judge agreed to unfairness and discrimination of the existing system, but he dared not to make the right choice, and restore justice where it has been deprived.

LGBT+ organizations: Hong Kong Court Only Willing to Consider Same-sex Marriage Rights in Split Scenario and in Judicial Review

The High Court in Hong Kong issued a verdict where the denial of inheritance rights of spouses in a homosexual marriage were ruled unconstitutional on Sept 18, 2020.

Judge Anderson Chow Ka-ming stated that the regulations discriminate between heterosexual couples and same-sex couples and lack a reasonable explanation, which constitutes as illegal discrimination.

The Attorney General claimed that local marriage law grants heterosexual couples a special status, and the members of heterosexual couples must bear the legal responsibility to support their spouse, so they cannot be treated the same as same-sex couples.

Judge Chow disagreed with the claim, stating that the original intention of the law is to prevent the deceased from evading the responsibility of supporting others. These include those who the deceased has to take care of in terms of legal responsibilities and moral responsibilities, such as their parents and brothers and sisters.

Chow stated that the Attorney General's view is wrong and reflects that the law treats opposite-sex couples and same-sex couples differently.

However, the judicial review filed by Jimmy Sham, vice convener of the Civil Human Rights Front (#CHRF) was shot down by Judge Chow on the same day.

Sham challenged previous ruling of the court, arguing that the refusal to recognise overseas same-sex marriages is in violation of the Basic Law.

Some LGBT+ organizations believe that Sham's lost case is extremely unfair and ironic, criticising that same-sex couples could only submit judicial review on various marital rights one at a time, that "you could only win if you cut the case." They asked, "Is it impossible to enjoy these rights without judicial reviews?"

Hong Kong Pride Parade 2020 Tells the World "Here and Proud" Despite Police's Objection

The Hong Kong Pride Parade was issued a Letter of Objection by the Hong Kong Police Force for the first time in 12 years. The original parade was prohibited, and it will now be held online.

This year’s theme is "Here and Proud". Before the gathering, spokesperson Jimmy Sham told the press that he was disappointed by the objection of the police, making it the first time the parade cannot be held under sunlight. Concerning the difficulty to calculate the number of participants online, Sham suggested that nowadays in Hong Kong, number of participants no longer matters.

Sham thanked 17 District Councils for supporting the parade and promoting it locally. Over 20 district councillors joined the event.

Sham, who is also a member of the Sha Tin District Council, pointed out that he was once told “it is very hard for gay people to become a district councillor”. This term, 3 gay people were elected, marking a new age for LGBTQ+ group. He also gave a special shout-out to the District Council members who promoted LGBTQ+ rights locally.

Singer Siufay, who came out earlier, was appointed the Rainbow Ambassador this year. He shared his experiences of coming out, “it is easier to step up than step back”. He said he had a lot of limitations before coming out, but now he can say whatever he wants.

Another Rainbow Ambassador is Figo Chan, the convener of Civil Human Rights Front. Chan added, Hong Kong is not familiar with gender issues, which creates discrimination. He hoped that one day these misunderstandings can be eliminated.

Benny Tai, Robert Chung, and fifty more Democratics arrested this morning for inciting subversion of state power through arranging ‘35+ Primary Election’

The #DemocraticParty suggested a ’35+ #PrimaryElection scheme’, hoping to secure over half of the seats in the #2019LegislativeCouncilElection, yet the election was cancelled later. The #NationalSecurityDepartment of Hong Kong Police Force arrested around #50Democratics.

Jimmy Sham Tsz-kit: Hope the world knows HongKongers are the glory of Hong Kong

Jimmy Sham Tsz-kit said he once understood the differences between abiding and breaking the law. However, the world has inverted black and white. Even under the authorities' suppression, he still believes that the Hong Kong government cannot detain all freedom fighters. Also, he always believes Hongkongers who had participated in the 2 million march persisted in their belief. He described, "Today is to temper our willpower." He hopes the world can see it and "Hongkongers are the glory of Hong Kong."

Jimmy Sham also apologised to Helena Wong Pik-wan, stating he feels sorry for The Democratic Party, and they hugged each other outside the police station.

HK Court Denies Bail for 36 in
#47Activists Case, Assigned Judge: "Five Demands" Endander #NationalSecurity

Among the 47 pro-democracy activists facing allegations of “conspiracy to commit subversion” in connection with a legislative primary election in Hong Kong in 2020, 36 of them have been denied bail.

'#LongHair' Leung Kwok-hung and Jimmy Sham Tsz-kit, who are the vice-chairmen of the League of Social Democrats, were among the 36 who were denied bail.

Both of them applied for bail at Hong Kong's High Court earlier, but Judge Esther Toh Lye-ping , the designated judge of the #NationalSecurityLaw, refused to grant them bail and ordered to hold them back in custody.

The senior counsel Hectar Pun representing Leung and Sham pointed out that they have never advocated "Hong Kong independence", colluded with foreign forces or requested sanctions against the Chinese and Hong Kong governments, nor did they sign the "No Regrets" online statement.

Pun also said that Leung's local ties are strong, he has recently gotten married and is suffering from coronary heart disease, so the risk of absconding is low.

Moreover, Sham has always been active in the local #LGBT community, he married his partner who is also a Hong Kong resident in 2013, so Sham has no interest in leaving Hong Kong.

The judge issued her reasons on May 13, 2021, claiming there was no good reason to believe the two would not continue to act against national security.

The judge cited that the Department of Justice's arguments against bail, saying that Sham still stated he would continue to fight for the "#FiveDemands", in front of the police station upon his arrival on Feb 28, 2021. This indicated that there was no reason to believe he would not continue to endanger national security.
