Man Accused of Possessing Poison Has Prosecution Withdrawn, Jeremy Tam Censures Police Arbitrary Arrests

After protestors occupied the Legislative Council building on July 1 last year, police officers intercepted multiple vans near Sun Yat Sen Memorial Park, and arrested a van driver for "Possession of Part I Poison" and "Possession of Instrument Fit for Unlawful Purpose".

Legislative Councillor Jeremy Tam Man-ho, who assisted the arrested driver, said that the driver was only found with asthma medication, stating that he "would have believed that this was some Golden Triangle drug smuggling case if one was not informed about it".

After he was notified that the driver had his prosecution withdrawn due to lack of evidence, Tam censured the police for conducting indiscriminate and arbitrary arrests, stating that the police "often frame Hongkongers", and noted the irony of the officers from the Regional Anti-Triad Unit, whose possession of methamphetamine made headlines in early May. He remarked, "The true drug smugglers may be the Regional Anti-Triad Unit who claims to be 'Serving Hong Kong with Honour, Duty and Loyalty'".

Police Arrest 16, Including 2 Legislators Charged With Involvement in 7.21 Attacks and 7.6 March

16 people, including Democratic Party legislators Lam Cheuk-ting and Ted Hui Chi-fung, online media reporter Hei Hei (熙熙) and others, were reportedly arrested on the morning of Aug 26, 2020, with 13 people charged with "rioting" under last year's Yuen Long 7.21 Attacks, while four people including Lam and Hui were charged with illegal assembly, perverting the course of justice, accessing computers with dishonest intent, property damage and other charges.

The Democratic Party had stated on social media that the police had separately arrested Lam and Hui at their residences, claiming their involvement in a last year's case regarding the Tuen Mun Police Station. The police also claimed that Lam had a rioting charge for his involvement in the Yuen Long 7.21 Attacks.

For Hui, the police claimed he had charges of accessing computers with criminal or dishonest intent, property damage among others.

According to Lam's social media account administrator, the police also claimed Lam had charges of conspiring others to damage property and perverting the course of justice.

CRHK and TVB and among others stated that 13 men, including Lam, were charged with rioting charges for last year's Yuen Long 7.21 Attacks. 3 men and 1 women, including Lam and Hui, were involved in last year's Tuen Mun Park case, with charges of illegal assembly, perverting the course of justice, accessing computers with dishonest intent, property damage among others.

According to online media reporter Hei Hei, police had a search warrant while searching his residence, later demanding him stop recording.

On 6 July 2019, netizens organised a "Liberate Tuen Mun Park" march. After the march ended, around 400 pro-democracy protesters gathered outside the Tuen Mun Police Station. According to reports that day, Lam and Hui were there to defuse the situation. Nearly all citizens dispersed at around 10 in the evening.

On 21 July evening last year, dozens of men in white shirts entered the Yuen Long MTR Station, YOHO Mall and other locations holding metal and wooden rods. At least 45 people, including Lam and former TVB News host Ryan Lau, were injured. Despite the amount of people phoning the police for aid, the police arrived late at the scene.

Police arrested 16 citizens including pro-democracy lawmakers Lam Cheuk-ting and Ted Hui on Aug 26, 2020.

In a police press conference on the same day, the police was asked by the journalists under what ground Lam, who is a victim of gangster attack in Yuen Long on 21 July, 2019, is charged with rioting on the day of the event.

The police evaded the question and claimed that "indiscriminate attack" is an "untruthful" description of the Yuen Long 7.21 Attack. Moreover, the police changed their earlier statement of having arrived 39 minutes late in Yuen Long. The police now claimed the time they took to arrive was "18 minutes".

The police also rejected the accusation of police-triad collusion on that day where the police allegedly turned a blind eye to the violent assaults inflicted by the white-clad gangsters on civilians and pro-democracy protesters.

The police was asked to explain a photo that captured a police officer tabbing a white-clad person on the shoulder but without stopping and searching the two men carrying long metal rods. The police said it was not a sign of collusion, but without providing further explanation. The police spokesperson also became agitated during the press conference, emphasizing "no matter what colour you are wearing, we will look into you!".

The police also questioned the journalists for "not knowing what happened in Yuen Long on 21 July 2019" and insisted that they did not turn Lam from "plaintiff to defendant". At around 1608, the police spokesperson left when journalists were still asking questions.
