China refuses to accept Hong Kong High Court's ruling on unconstitutionality of Face Mask Ban

Editor’s note: On 4 Oct, the Hong Kong Government invoked the rarely-used colonial-era Emergency Regulations Ordinance to implement the prohibition
on Face Covering Regulation (PFCR), an anti-mask law[46] in response to the ongoing protest this year.

(19 Nov) Hong Kong's High Court has ruled on Prohibition on Face Covering Regulation (Cap. 241K) yesterday (18 Nov) that “The restrictions it imposes on fundamental rights [...] go further than is reasonably necessary,” and was therefore unconstitutional. For that, Hong Kong and Macau Affairs Office of the State Council spokesperson YANG Guang expressed grave concerns over the serious and negative implications on the society by such ruling, and said this was a blatant challenge to the authority of the Standing Committee of the National People’s Congress (NPCSC), as well as the ruling power endowed to the chief executive by law. He said this would create serious and negative effect on the society and police, and would closely monitor the continuing development of the case.

Singaporean activist charged with illegal assembly after inviting Joshua Wong to video conference

Jolovan Wham, a Singaporean Activist, invited Joshua Wong [formerly] from Demosisto to give a video speech in 2016 event through Skype. Wham posted on Twitter yesterday (20 August) that the court has rejected his conviction appeal. He refused to pay the fine, as a result, he will be jailed for ten days from today.

Jolovan Wham, aged 40, is a social worker who advocates for sexual minorities, freedom of assembly and free speech. He hosted a forum on civil disobedience and social movement in November 2016 and invited his 7,600 followers on Facebook to join. On the day, there were a few overseas activists who gave speeches, Joshua Wong also spoke in the meeting via Skype.

According to The Straits Times from Singapore in October last year, Wham’s lawyer pointed out in the trial that this event was not defined as an “assembly” under the law, but an academic discussion only, it did not have immediate threat to public order and safety. Yet, the High Court in Singapore rejected Wham’s appeal. The judgement stated that Wham promoted social reform through civil disobedience at the meeting; and that he invited Joshua Wong to the meeting, who was undoubtedly expected to promote civil disobedience. The court believed that Wham was telling the audience about how civil disobedience was practised in Hong Kong, and invited them to peruse civil disobedience in Singapore, which was enough to determine there was promotion of civil disobedience.

In the end, Wham was convicted of organising an unlawful public assembly and refusing to sign a police statement. He was sentenced to fines of $2,000 and $1,200 Singapore dollars respectively for the two convictions (approximately equivalent to $11,300 and $6,800 Hong Kong dollars). Wham made statement on Twitter that he refused to pay the charge of $2,000 resulting ten days imprisonment starting from today (21 August). He also expressed his appreciation of the support from everyone on Twitter.

Former Lawmaker on Suspicion of Security Law Breach Granted Bail

The decision came as the High Court continued to deal with a challenge by the prosecutors to a lower court’s decision to grant bail to 11 of the pro-democracy activists and politicians, including Wong.

When leaving the court, Wong was welcomed by a large group of supporters.

She stopped briefly to talk to media representatives, saying that she wanted to go home and share some time with her family.

Soon afterwards, she left the scene with her husband and friends.

Detained HK Activist #OwenChow: Good Works Are Always Born in the Worst of Times

On June 22, 2021, Owen Chow, a 24-year-old pro-democracy activist, was finally granted bail after being detained for months.

Chow was among the 47 pro-democracy figures who were arrested by the police for participating in the Primary Election of the pro-democracy camp in 2020. They were charged with subverting the state under the National Security Law.

Among the 47 people detained, Chow is only the 12th person who has been granted bail; however, he was barred by the High Court from making any speeches or take part in any action that could be seen as "endangering national security". He cannot participate in any elections or contact foreign officials.

In addition, Chow has to surrender all his travel documents and not to leave Hong Kong. He has to report to the police every evening and observe an overnight curfew.

Leaving the detention center for the moment, Chow said to the journalists, "Good works are always born in the worst of times."

The High Court ordered the confiscation of 70 million from Spark Alliance, an organisation that helped raise funds for activists arrested in the anti-ELAB movement. Spark Alliance was formed in 2016 after the Mongkok riot. During the movement in 2019, they raised funds to support arrested activists' legal and daily life needs. The police arrested 4 people from this organsiation on 19 Dec 2019, accusing them of money laundering and froze around 70 million.
