Pulitzer Prize-winning photojournalist: as a Hong Konger, there is no way to be happy

(09 May) A one-way plane ticket led Reuters' photographer, Tyrone Siu, back to Hong Kong at the end of May last year. He was originally stationed in Taiwan and planned to be in Hong Kong only to report on the annual candlelight vigil of the June 4th Tiananmen Square massacre. Instead, he stayed for almost a year and witnessed Hong Kong’s most chaotic days. He and the team at Reuters even won the Pulitzer Prize in the Breaking News Photography Award this year for their series on Hong Kong anti-extradition bill movement. He described his feeling of winning the prize as very complex. "As a journalist, it is a great honor to win the Pulitzer Prize. It may be what a lot of media workers aspire to achieve. But as a Hong Konger, being in the story, and knowing that many people have been injured in it, I can't say that I am happy about a movement that hurts us all.

Just to be clear, there’s no such thing as a ‘fake journalist’ or ‘illegal reporting’ in Hong Kong.

(11 May) In Hong Kong, the freedom of press and the right to report is guaranteed by the basic law. You and I, and a 13-year-old student, can be journalists.

Under Article 27 of the Basic Law, all Hong Kong residents shall have freedom of speech, of the press and of publication. The Hong Kong Rights and Democracy Act also contains provisions to protect the press, publication and information.

Press freedom includes the right to interview, investigate, edit and comment without government interference, which is not a fundamental human right enjoyed only by journalists employed by commercial media, but by all residents in Hong Kong.

In short, everyone can be a journalist in Hong Kong.

There is no specific law regulating news coverage in Hong Kong. The Hong Kong Journalists Association (HKJA) issues membership card, which has nothing to do with whether a journalist is “real” or not.

Then maybe you’d ask, “Wow, so any irrelevant person can be a journalist?” That’s right. “So it is unregulated?” That’s right.

If you ask me, I’d rather it be “unregulated”. There’s a place where the government issues press cards, and journalists have to obtain official accreditation before they can report. That place is called the People’s Republic of China.

Especially in these chaotic times, I’d rather have more journalists on the scene. We’d be able to get more coverage with more cameras, so the public would know exactly what’s going on, which is important and also the best way to protect everyone (including the police and protestors).

Yesterday, the Hong Kong police targeted journalists intentionally, hoping to beat them up until they become too scared to report, so the public wouldn’t be able to see what the police did and how they treated protestors (or pedestrians) behind the cordon.

To be honest, suppressing press freedom would do no good to the police – why did no one believe them when they repeatedly “clarify” that they didn’t beat anyone to death during the 831 incident (31 Aug last year)? Because they kicked all journalists out that day.

Are journalists really unregulated? In fact, it relies on public scrutiny and the journalists’ professional integrity. Since anyone can be a journalist, the credibility of journalists must be maintained by journalists themselves. (That’s why some experienced journalists criticize online media journalists who swear and provoke the police when they are broadcasting live. This damages the press’ credibility. I’m not going to repeat too much of what other experienced journalists have said).

I would like to tell the 13-year-old journalist that his journalist vest is well-deserved based on his professional behavior. He is more righteous and competent than many so-called adults.

Two Australian Correspondents Evacuated from China Following Inquisitions by State Security Agents, Union Calls China and HK “Unsafe for Foreign Journalists

Another diplomatic row between China and Australia took place as Chinese state security agents went knocking on the doors of two Australian correspondents stationed in China and questioning them last week. Both journalists have returned home with arrangements made by their organizations and the Australian diplomatic mission in China.

The Australian Broadcasting Company’s (ABC) Beijing correspondent Bill Birtles and The Australian Financial Review’s (AFR) Shanghai correspondent Mike Smith were subjected to multiple rounds of questioning by Chinese state security agents last week. The interviews dealt with Cheng Lei, an Australian employee of the CCTV arrested last week. Earlier last week, diplomats in Australia reminded Birtles to leave China as soon as possible. Relevant suggestions were made by the Australian foreign department to the ABC’s managing director David Anderson. The ABC went on to arrange a flight home leaving last Thursday for Birtles.

On the day before Birtles’ return (2 September), however, seven Chinese police officers went to his home in Beijing late at night when Birtles was having a farewell party with his friends. The officers told Birtles that he was not allowed to leave China and that the police will contact him the next day to schedule an interview about a case concerning national security. Birtles approached the Australian Embassy in Beijing for protection, during which he was contacted by the Chinese authorities again and asked to be questioned.

Beijing Fumes as Australian Intelligence Searches Residences of Four Chinese Correspondents, Cries “Gross Violation of Right to Report”

China’s relations with Australia have become tense as two Australian correspondents in China, now evacuated, had a knock on the door from state security agents and was subjected to rounds of questioning. Chines state official media reported that the Australian authorities had recently searched the residences of four Chinese journalists stationed in Australia. The Chinese foreign ministry blasted the Australian government for “seriously interfering with the normal journalistic activities of Chinese media organizations” and “grossly violating the legitimate right to report of Chinese correspondents in Australia”.

The Global Times reported on 9 September that Australian intelligence officers had recently raided the residences of Chinese correspondents in Australia. The report said that the authorities interrogated the reporters for an extended period of time, seized their computers and mobile phones, and asked them not to report on the state of the investigation.

Spokesperson for the Chinese foreign ministry Zhao Lijan said at the press conference that to China’s understanding, the Australian intelligence agency placed under investigation four reporters working for Xinhua News Agency, CCTV, and the Australian bureau of China News Agency on suspicion of breaking the Foreign Intervention Act.

Zhao insisted that Chinese reporters in Australia abide strictly by local laws and regulations while conducting interviews and reporting objectively and fairly. These reporters, Zhao said, have done a large amount of work to promote mutual understanding and friendly exchanges between the two countries. What the Australian government did, he said, has “seriously interfered with the normal journalistic activities of Chinese media organizations” and “grossly violating the legitimate right to report of Chinese correspondents in Australia” while seriously harming the physical and mental health of the journalists and their families. Zhao said further that it has fully exposed the hypocrisy with the ‘press freedom’ and the so-called ‘respect and protection for human rights’ Australia champions.

Chinese State Media Condemns Searches of Correspondents’ Residences in Australia, Canberra Says Will Act Against Criminals Masquerading as Journalists

Tensions between China and Australia rise as a number of state-controlled Chinese media organizations including Xinhua News Agency, the Global Times, and China News Service took turns to accuse the Australian intelligence of having “brutishly” and “barbarically” conducted searches of the residences of Chinese correspondents in June and confiscated their equipment. The Australian home minister Peter Dutton refused to comment on the searches in an interview on 13 September. He admitted, however, that the authorities had taken some actions and would enforce the law where there is sufficient evidence.

In his interview with the Australian Broadcasting Corporation (ABC), Dutton said the government has the power to gather intelligence to prevent foreign interference. He refused to comment on whether any Chinese journalists had had their residences searched and been interrogated in June, stating only that the investigation was still underway. He admitted that the intelligence authorities had undertaken some activities, saying there was no evidence that the actions taken by the authorities had put Australian correspondents in China at risk.

Where the Australian Security Intelligence Organisation (ASIO) has sufficient grounds, said Dutton, searches or other appropriate actions will be carried out. “If people are masquerading as journalists or business leaders or whoever they might be and there’s evidence that they are acting in a contrary nature to Australian law, then ASIO and the Australian Federal Police and other agencies will act,” he said.

‘You will be put into detention': Former ABC bureau chief tells story of fleeing China for first time

Former ABC's China bureau chief, Matthew Carney, decided to immediately leave China with his family before their visas would expire in less than a week because the authorities had threatened to detain his 14-year old daughter. Carney was berated for any "negative China coverage" as he had reported the mass detentions of Uyghurs in Xinjiang.

Foreign journalists and their families are under Chinese authorities' surveillance. One way the Chinese authorities try to force foreign journalists to self-censor their work is by threatening them not to renew the 12-month residency visas.

HK Government's New Service Might Let Journalists Be Doxed

In Hong Kong, vehicles' information used to be accessible upon application to the Transports Department. This service had been used by many journalists when conducting investigations.

In November 2020, the authorities, however, targeted RTHK journalist Bao Choy, who produced two TV documentaries on the July 21 Yuen Long mob attack, by arresting her for "giving false statements" when looking up vehicle owners' information.

Worse still, in January 2021, the Hong Kong government introduced a new service where car owners could choose to be notified if the information of their vehicle is disclosed. Once subscribed, the owner will receive an email notification containing the information of the applicant.

Former lawmaker Claudia Mo commented that the new service would expose the identity of the journalists and put them in potential danger.

Journalist Suspended by #RTHK Before Court's Ruling: I Feel Being Doubly Punished

RTHK journalist #BaoChoy appeared in court on Jan 14, 2021. She was accused of making false statements and violating the Road Traffic Ordinance by "not disclosing the real reason" for licence plate checks in 2020. Choy pleaded not guilty.

Choy produced two episodes of the news documentary "Hong Kong Connection" with an aim to find the perpetrators of the Yuen Long 7.21 mob attack, which injured many pro-democracy protesters, journalists and civilians on July 21, 2019.

Since Choy was arrested in November 2020, the public broadcaster RTHK has suspended her duties.

The RTHK Programme Staff Union voiced their support for Choy outside the court. After the hearing, Choy said she was disappointed with RTHK's decision before any trial took place. She felt being punished for twice for doing her job.

“I would expect RTHK to take up its moral responsibility, as well as showcasing the integrity of a media organisation. From this perspective, the decision of RTHK management to suspend me from my role as a journalist and producer of Hong Kong Connection was quite disappointing for me.”

A journalist in exile suspected of being kidnapped back to Iran across the border and being executed

Iran government sentenced the 47-year-old journalist Ruhollah Zam, who was once in exile to France, to death because of "corruption" on Saturday (12th December). The journalist was accused of cooperating with foreign intelligence departments, sharing protest information as well as making teachings on gasoline bombs on his Telegram channel. The French government, human rights organisations, Reporters Without Borders and Committee to Protect Journalists all condemned the execution, describing it as “a fatal blow to Iran’s freedom of speech”.

Zam fled to Paris after being accused of cooperating with foreign intelligence departments in 2009. He subsequently started operating website “AmadNews” and his telegram channel, having over 1 million followers. He shared Iran protest information and scandals of Iran officials on his channel in 2017, and tutorials for making gasoline bomb. Telegram has once blocked his channel due to complaints from the Iranian government.

HK Journalist Leaves Post After Being Attacked by Pro-China Group for Filming Documentary on Xinjiang’s 'Education Camp'

A number of RTHK programs and journalists in Hong Kong have been repeatedly attacked by pro-China groups.

Among them is Yvonne Tong Yeuk-wun who hosts the English-language radio program "The Pulse" .

During her interview with #BruceAylward, the assistant director general of the #WHO in 2020, Tong raised a question of whether the management of WHO would reconsider the membership status of Taiwan.

Since then, she has been repeatedly targeted by pro-China activists. The #AppleDaily reporters have received information from sources at RTHK saying that Tong is suspected to have resigned from the ongoing pressure and will leave within this week.

A pro-China group went to RTHK earlier this month, accusing Tong of "using public money" to produce "anti-China fake news" by claiming that over a million people are being imprisoned in Xinjiang.

They demanded the station to have her fired. This is not the first time that pro-China groups have come to RTHK to protest against Tong.

Since the end of March in 2020, Tong was accused of violating the "#One China" policy by pro-China groups and even by The Commerce and Economic Development Bureau
after interviewing the WHO representative on "whether Taiwan's membership would be reconsidered".

Amen Ng Man-yee, the former head of Corporate Communications & Standards at RTHK, responded that Tong was carrying her job as a journalist and asked the question in a very matter-of-fact manner without any special meaning.

On April 22, 2021 the day Hong Kong court found in investigative reporter #BaoChoy guilty over car license searches made for news report, the European Union Office to Hong Kong and Macau immediately expressed concern about the situation in Hong Kong and pointed out that "the law should not be deployed in a way that stifles legitimate journalism."

The Office also alerted that in the case of Hong Kong, "press freedom cannot be taken for granted."

On April 23, 2021, #NedPrice, spokeperson of the State Department of the United States, condemned the prosecution of journalist Bao Choy by the Hong Kong authorities. He expressed that "the U.S. is deeply disappointed in the conviction of Hong Kong journalist Bao Choy for merely doing her job."

Price recgonized Bao Choy "a champion of press freedom (guaranteed by the Joint Declaration) whose important contributions were just recognized by the Kam Yiu-yu Press Freedom Award."
