Chinese-controlled Media: Beijing to Bypass Hong Kong's Legislature and Push National Security Law
According to Chinese-controlled news media South China Morning Post, Singtao Daily, OnCC and HK01, the PRC's Chinese People's Political Consultative Conference (CPPCC) members in Beijing were notified to attend a briefing session in the evening of May 21. Xia Baolong, Chinese Communist Party member and director of the Hong Kong and Macau Affairs Office, is expected to be present.
Some delegates foresee that Beijing will address Hong Kong’s national security issues at the two sessions ("lianghui"), including appending national security legislation into Annex III of the Basic Law for the so-called purpose to curb "foreign interference and terrorism".
Sources said Beijing will invoke Article 18 of Hong Kong's Basic Law and directly annex the anti-subversion law into the city's constitution have earlier announced their similar proposals to Beijing.
According to Apple Daily, foreign consulates from US, UK, Canada, Japan and Australia and the European Union office in Hong Kong have yet to receive any similar news.

Law Professor: Beijing's Insertion of National Security Law in Hong Kong Means an End to "One Country Two Systems" and the Basic Law
The National Security Law will pose profound impact on Hong Kong’s human rights and constitutional system.
Professor Johannes Chan Man-Mun of the Law School of the University of Hong Kong criticized that Beijing's insertion of the anti-subversion law in Hong Kong's constitution will violate the spirit of "self-legislation" as promised. Chan said, "This series of incidents in the past week has shown Beijing's tightened grip, disappointing many people. It has become impossible to believe that one country, two systems still exists!"
Chan said that Article 23 of the Basic Law stated that Hong Kong will enact the national security law on its own. He stated that bypassing Hong Kong's legislature to implement the National Security Law is a violation of the Basic Law, and also further confirmed that there is no 'one country, two systems' at all.
"If the Article 23 can be imposed like this, what laws can't be enacted? It means that all PRC's laws can be applied (to Hong Kong). When self-legislation has been promised, this is not 'one country, two systems' at all."
"The Article 23 of the Basic Law must either be amended or abolished, otherwise the direct implementation is breaching the Basic Law."
Regarding this new version of the National Security Law, which is going to be implemented and enforced in Hong Kong, the definition of "subversion" is unclear and it is uncertain as to how it would meet the existing criminal law requirements of Hong Kong. Chan reiterated that the National Security Law will also put pressure on the judiciary of Hong Kong.
"Accepting whatever Beijing says puts the court in a very difficult position. If you insist on the common law, is it up to you to interpret the law? If the case involves national defense, will it be handed over to the military court of the People's Liberation Army and let the case be judged inside the High Speed Rail Terminal?", Chan challenged.
As the convener of many Anti-Extradition Bill protests, the Civil Human Rights Front has just sent urgent letters to many consulates in Hong Kong, expressing their opposition to any laws that interfere with the freedom of expression, religion, assembly, and political participation. They called on the international community to pay attention to this "critical moment in the freedoms of Hong Kong".
The Civil Human Rights Front also condemned Beijing's forceful implementation of the National Security Law in Hong Kong is a "revenge against Hongkongers", a "total erosion of the rule of law and basic human rights originally protected under the Civil and Political Rights and the Human Rights Law and a threat to "the status of Hong Kong as an international financial center."

The agenda of the session, set up by the Standing Committee of the National People's Congress includes a motion that concerns the "establishment of the legal system and implementation mechanism for the maintenance of national security in the HKSAR".
Eric CHEUNG Tat Ming, solicitor and Principal Lecturer and Director of Clinical Legal Education in the Department of Law in the University of Hong Kong, believes that the motion covers laws that would be covered by the Basic Law Article 23 were it to be established. Yet Article 23 clearly states that the Hong Kong is to "enact laws on its own" regarding such matters.
Cheung stated that the passing of said motion would indicate the Central Government's little-remaining patience, as it would not wait for Hong Kong to enact its own laws or declare that the Hong Kong Government violated the constitution, and instead acted to give legislative power to itself to enact laws on their own.
Cheung believes that, the Central Government is enacting a tailor-made law designed for the situation in Hong Kong under the guise of enforcing a nationwide law through the use of Appendix 3 of the Basic Law, which indicates that the Central Government is legislating laws on Hong Kong's behalf. This act, he believes, would utterly violate the Basic Law, and annul the One Country Two Systems model.

A three-day meeting was held by the Standing Committee of the National People's Congress in Beijing last week, with details of the National Security Law draft being discussed during the meeting.
According to China state media Xinhua News Agency, the definition and the criminal responsibility of secession, subversion of state power, terrorist activities, collusion with foreign or abroad forces to endanger national security were discussed. Moreover, the wordings in one of the four criminal offences described by the Xinhua Agency has been changed from "foreign or abroad forces to intervene in affairs in HKSAR" to "collusion with foreign or abroad forces to endanger national security"; which some interpreted the amendment as a target to local individuals and organisations.
The Xinhua Agency also indicated that drafting the law itself is an important process that affirms the Committee's hope and need to pass the Law.
In an interview, Johannes Chan, Chair Professor of Law at the University of Hong Kong, said in the details of the draft announced, "collusion with foreign or abroad forces to endanger national security" includes inciting, conspiring, convincing, or even unilaterally planning of criminal activities. With the Chinese government vesting the power of interpretation, Chan worried that the definition of criminal offences can become arbitrary, and might vary from time to time. He also expressed concern that the promise of "one country two systems" and Hongkongers' protection under the Basic Law are no longer valid since the new Law overrides the Basic Law, and charged Hongkongers can be sent to the mainland for trials.
Chan also emphasized that protecting national security does not justify random accusations and sentencing or even executing without going through trials. The idea that "national security should overrules everything" is an misleading concept, and will only result in tyranny.

How double standard works
(11 Aug) In response to United States new rule on origin country and made of Hong Kong products, Hong Kong Government released a statement on 11 Aug 2020 to strongly opposite the new rule and criticise US measures contravened WTO rules, by explaining that Hong Kong is a separate member under WTO, special status as a separate customs territory is granted under “One Country Two System’ which is conferred by the Constitution of China under the Basic Law.
The Hong Kong Government news press is ridiculous and is absolutely inconsistent with what the Chief Executive of Hong Kong rationalised the legislation of National Security Law in Hong Kong by explaining “our Country”, China, has its right to “protect” Hong Kong by implementing China’s law to the local level; completely violated the fundamental spirits of “One Country Two System” or “Basic Law”.

The East Asia Summit, held by leaders of China, the U.S. and Japan, was held by video conference on Saturday (14th November). At the meeting Japanese Prime Minister Yoshihide Suga said developments contrary to the rule of law have been unfolding in the region, including the South China Sea. He also express grave concerns over the the enactment of the National Security Law in Hong Kong, urged upholding a free and open system under the "One Country Two System" framework.
According to Kyodo News, in the dispute over the sovereignty of Senkaku Islands (a.k.a. On Sunday, Feb 28, 2021, in Hong Kong, Tsuen Wan district councillor #RoyTam Hoi-pong of Neo-democrat and former lawmaker #WanSiuKin of Democractic Party reported to the Tsuen Wan Police Station in the afternoon, as instructed by the Hong Kong Police 2 days ago.
They are among the 55 pro-democracy activists who were arrested on Jan 5, 2021 on suspicion of "subverting state powers" and violating the #NationalSecurityLaw.
As the group was ordered to report to the police over 1 month ahead of the scheduled date, many had prepared for the worst. It was proven to be the case, as on the afternoon of Feb 28, the Hong Kong police announced charging 47 pro-democracy figures with "conspiracy to subverting state powers", and that they would be detained overnight before sending them to court the next day.
Before walking into the Tsuen Wan Police Station to face whatever plans the authorities have for them, Roy Tam, who came hand in hand with his wife, hugged his friends and families. He told the media that he would "face it with a calm spirit". Tam raised his fists high and said, "Hongkongers, hang in there!"
Wan Siu-kin arrived moments later. He said he was not surprised, as arbitrary arrests are nothing new in Hong Kong. A former lawmaker himself, he firmly believed that he did not violate the #NationalSecurityLaw, nor the Hong Kong's Basic Law. He told his friends that he is not afraid and will embrace the challenges. He hopes all the pro-democracy figures arrested would show the same fighting spirit.
Wan added, "To be frank, I don't know what to tell you, if you ask me for methods to resist against the authoritarian regime. But there is one thing you can do: Be a human-being, be yourself."
When asked to comment on Beijing's reported plan to amend Hong Kong's electoral system, Wan said, "I cannot comprehend the logic of the authoritarian regime, and do not want to."
Wan emphasized that the crux of the problem is the erosion of the social, economic, and political structure of the city. He concluded that the "#OneCountryTwoSystems" policy should be genuinely practiced, but "not by way of any twisted interpretation".

The National Committee of the Chinese People's Political Consultative Conference (#CPPCC) opened on March 4. Chairperson Wang Yang gave a report of the Standing Committee's work, in which passages on Hong Kong and Macau issues were cut down substantially.
For the second year in a row, the report omitted wordings such as “Hong Kong people ruling Hong Kong” and “High degree of autonomy”. Even “#OneCountryTwoSystems”, which appeared in last year's report, was no longer mentioned this year.

The European Commission and the High Representative have on Mar 12, 2021 reported on political and economic developments in the Hong Kong Special Administrative Region.
EU High Representative/Vice-President Josep Borrell said: “Over the course of 2020, we have witnessed an alarming political deterioration in Hong Kong. The National Security Law imposed by Beijing is being used to crack down on pro-democracy forces, stifle dissent and pluralism, and erode fundamental freedoms. The arrest of dozens of pro-democracy activists in January this year confirmed that this trend is accelerating.
"China is consciously dismantling the 'One Country, Two Systems' principle in violation of its international commitments and the Hong Kong Basic Law. The regressive electoral changes approved yesterday in Beijing are yet another step down this path.”
The report highlights that, over the course of last year, Hong Kong experienced a further severe erosion of its high degree of autonomy, its democratic principles, and the fundamental freedoms that the Chinese authorities committed to protect until at least 2047.
