Hong Kong police changed their statement on facebook

In an earlier post (left) released on October 9, one of the hashtags writes #PoliceNeverEnterDeliveryRoom.

One hour later, the hashtag was removed (right).

This happened after the police denial of having entered the delivery room was debunked by witness report.

Police Provide Preferential Help to Chinese Students while Assaulting the Locals

Police admitted on Facebook that they assisted a group of Chinese students to retreat from the campus of the Chinese University of Hong Kong (CUHK) on November 13.

The heading given to this post is "Police help CUHK students". Ironically, police fired over 1000 tear gas canisters and over 1000 rubber bullets and other rounds into the university campus yesterday, even during the University Head-students dialogue and despite their agreement to cease fire.

"Will the police be held accountable?" Police: No comment


The magistrate strongly rebuked the police officers who gave evidence in court for lying repeatedly, sophistry, unfounded speeches, inconsistency, and improper performance of duties.


Over a year since the anti-ELAB movement, more than 2,000 people have been prosecuted. Stand News has compiled more than 300 completed cases. Statistics found that at least 21 cases were not convicted because police officers’ statements were not accepted by the judges, involving at least 30 police officers, with their ranks from junior police officer, sergeant, trainee inspector, to senior inspector.

A barrister pointed out that the role of the police in court should be presenting the collected evidence in court accurately and in truthfulness. When a police officer makes a false statement in court and deliberately misleads the court, he too can also be prosecuted.

Stand News asked the police whether they would pursue the 30 police officers criticized by the officers. The police refused to respond positively on the grounds of "not commenting on individual cases."

Shek Su-Ming, executive committee member of the Barister Association, said that problems with police officers' testimony have occurred in the past, not just in anti-ELAB cases. However, in recent days, the magistrate's intensive and severe criticism is more "special" and "really catches it well." Ng Chung Luen, a practising barrister and former convener of Legal and Political Science, pointed out that the police sometimes made human errors in the process of producing evidence. It was originally understandable. However, recently the magistrate accused the police officers of giving false statements to the police have drawn worthy attention to the problem.

Even if the police officers were severely criticized by the judge, most of them had no consequences.

Part 2/2

Only two police officers have been punished for false testimony in the past 5 years. No one was with prosecuted.

The Security Bureau responded to Legislative Council Member Jeremy Tam Man-ho’s question in July this year. In the past five years, a total of 2 police officers have been disciplined for questioning the credibility of their testimony by the court. In 2016, one person was issued a minor disciplinary report. The other person was sentenced to be "reprimanded" in 2019 after a disciplinary hearing; no police officer was prosecuted.

However, the Security Bureau has not disclosed which case the police officer was disciplinary action involved.

Shek Su-Ming pointed out that he has no impression on cases that police officers will have consequences if they fail to testify, whether it is prosecution or internal condemnation for "false oaths".

Ng Chung Luen said: "The law says that (police officers) giving false statements can theoretically be prosecuted." He mentioned that false statements are criminal offenses. "Will the Department of Justice require the police to investigate? I haven't seen that happen yet. I didn’t notice that the Attorney General would investigate.”

Some of the police officers who were criticized confessed anonymously

In a number of cases, the Department of Justice has avoided being "undergrounded" as a reason, and applied to the court for an anonymous order for police officers who will appear in court to give evidence. Some officers criticized the police officers for giving anonymous confession as Sergeant A and Officer X. The public has no way of verifying their true identity.

More than half of the 21 cases which a police officer gave evidence but were not accepted by the officer, 13 cases were assaults on the police. Most of the cases were based on footage collected by the defendant to overturn the charges.

HK News Channel Forbids Staff From Donning Black

Pro-democracy lawmaker, Lam Cheuk-ting was arrested on August 26, 2020 on suspicion of rioting on 21 July 2019. Lam was known to be a victim among many other civilians that day in the Yuen Long 7.21 mob attack that day.

The public, much astonished, condemned the police for deliberately confounding right and wrong. Netizens called for civilians to “wear black” on August 27 to show their discontent to “police lies”.

Sources revealed that the management of Now TV issued a notice that reminded the news department and particularly reporters and news anchors to avoid donning black.

The reminder claimed that it is a "long standing practice" for reporters and anchors not to show up in front of camera in "any sensitive colors closely associated with social movement" in order to "show their neutral position".

The staff described this reminder from the management as a rare action, reflecting the lack of trust in reporter’s judgement and journalistic professionalism.

Police's testimony found inconsistent with video; Man acquitted of two charges

Due to the suspect of unknown gas leakage at Tai Hing Police Operational Base on Oct 30, 2019, a large crowd of civilians protested against the incident. Police dispersed the crowd at that night and arrested a 23-year-old waiter of illegal assembly and possession of offensive weapon.

In the first hearing on this case on 15 Sep, 2020, the police officer arresting the suspect recounted the process of intercepting and arresting in the court. However, the progress described could not be found in the video provided by the defendant lawyer.

In the adjudication on 16 Sep, 2020, Magistrate Wong Ching-Yu rejected the police officer’s statement, and the defendant was acquitted of two charges.
