Impact of National Security Law

(25 May) As a matter of fact, the Chinese Communist Party's (CCP) National Security has been secretly operating in Hong Kong. In 2016, the United States issued a human rights report that Paul Lee's disappearance was suspected to be related to national security, which was quickly denied by the Hong Kong government by saying that "law enforcement agencies outside Hong Kong have no authority to enforce the law in Hong Kong", indicating that they also knew that the truth could not be revealed. The abduction of businessman Xiao Jian-hua at the Four Seasons Hotel in 2017 also caused a stir for a while. Interesting enough, the Police's Hong Kong Island Regional Headquarters received a call for help, but as the matter greatly overstepped the limits of what they could handle, the embarrassment of the Hong Kong Police investigating the National Security was avoided on the pretext that "the subject has reported his safety to the police and his family has requested for the case to be dismissed". 2. Article 92 of the Basic Law states that judges are to be appointed on the basis of their judicial and professional qualities, not “designated on the basis of political considerations.”
3. Judges of foreign nationality are “expressly permitted to be appointed as judges in Hong Kong under the Basic Law.”
4. “In considering the suitability of judges to be designated, any legal objections will have to be taken into account, such as those set out in Article 44 as well as those based on bias, reasonable perceptions of bias or “other legal objections.”
5. “The listing and handling of cases, the assignment of which judge or judges are to handle cases or appeals will be determined by the court leader of the relevant level of court.”

Joshua Wong Questions the Authorities' Larger Plan of Prosecution under the National Security Law In Disguise of Disqualifications

In a press conference held on July 31, Joshua Wong said the accusations ruled by returning officer of the Electoral Affairs Commission were “ridiculous”. Wong pointed out that this is not only about barring him from running for the LegCo Election, but also a larger plan to prosecute him under the national security law, after twisting his views.

Regarding the Returning Officer's request that candidates believe in the Basic Law, Joshua Wong questioned whether the Basic Law has risen to the religious level. [1] He also doubted how much Hong Kong Chief Executive Carrie Lam and former Chief Executive Leung Chun-ying and his family believe in the Basic Law when they "hold British passports and are British".

In addition, the Returning Officer’s approach is to completely ban international connections, which is tantamount to announcing to the international community that "Hong Kong is shut down."

Wong commented that the Returning Officers treated the work of international connections like a witch hunt, and that the whole process felt more like a correspondence with national security officers than replying to a query from a "low-grade civil servant."

Finally, he stated that he would continue to play his role in the democratic movement, and he also solemnly stated to the Beijing government, the SAR government and the Returning Officer that "You can't kill us all."

HK's Education Bureau disparages “Basic Law”, Claiming Constitution of PRC Applies in Hong Kong

In June, the Education Bureau launched a series of posters as teaching resources for “Constitution” and “Basic Law”. In one of the posters, it stated that the Constitution of the People’s Republic of China applies in Hong Kong; it also stated that Basic Law is not nationwide, so it cannot override Constitution of PRC.

A barrister in Hong Kong suspected the information to be a disparagement of Basic Law, claiming that Constitution of PRC and Basic Law should have the same judicial status in Hong Kong on a legal basis. Only Article 31 of Constitution of PRC is related to the establishment of HKSAR, whereas others are not applicable to Hong Kong.

Moreover, Apple Daily found on the internet that most of the information on that poster copied from a scholar in China supporting Constitution of the People Republic of China.

HK Secretary of Justice Revokes Private Case Against Policeman who Shot Student with Live Round

Hong Kong Secretary of Justice Teresa Cheng intervened on Aug 17, 2020 to revoke a private prosecution on the police officer who shot a 21-year-old student with live rounds in Sai Wan Ho, on Nov 11, 2019.

The private prosecution was filed by Legislative councillor Ted Hui in January 2020, charging the officer with shooting with intent imparting grievous bodily harm on a civilian. The case had already been approven by a district judge.

In a statement released on 18 Aug 2020, Hui said he was furious at the Cheng's decision, and is considering to apply for judicial review.

The police officer was scheduled to appear in court on 31 Aug 2020, but the Secretary of Justice applied to have the revocation processed before 28 Aug. Hui blasted Cheng's decision as a barbaric interference with the judicial process, and questioned if her intentions were to endorse police violence and defend the force, regardless of their actions.

Hui further remarked that this decision severely impedes the citizen's right under Common Law to file private prosecutions, and shows the world that the Hong Kong government has "replaced the Rule of Law with the Rule of Man".

The police officer had also applied for judicial review last week demanding the case be dismissed, and further alleging that the process of private prosecution violates the Basic Law.

A Brief History of GATT and WTO:

Hong Kong acquired the membership of the General Agreement of Tariffs and Trade (#GATT) as a separate customs territory in 1986.

On 1 January 1995, the World Trade Organization (WTO) replaced the GATT, which had been in existence since 1947.

The governments that have had signed GATT were officially known as “GATT contracting parties”. Upon signing the new WTO agreements, they, including Hong Kong, officially became known as “WTO members”.

The Basic Law of Hong Kong Special Administration Region (HKSAR) was enacted in 1997. Article 116 of the Basic Law provides that HKSAR shall be a separate customs territory.

China became a WTO member on 11 December 2001.

Secretary for Commerce and Economic Development Edward Yau Tang-wah, however, claimed that China, which became a member of WTO only in 2001, had permitted Hong Kong to be a member of WTO in 1995 based on Basic Law, which took effect in 1997.
