Further Erosion of Rights: Hong Kong Police Obtain Power of Search of Mobile Phones without Warrant

On April 2, 2020, the Hong Kong's Court of Appeal reverts the ruling of the High Court and grants the Hong Kong police power to access the digital content of mobile phones, without the need to obtain a warrant.

The appeal was submitted by the police commissioner in opposition to the High Court's ruling made in 2014. During the annual July 1 protest in 2014, the phones of five pro-democracy activists were confiscated by the police. The group filed a judicial review and the court ruled that it is unconstitutional for the police to have such power.

Regarding the new ruling in 2020, concerns are raised over the infringement of personal privacy and the further erosion of rights. The judgement stated that refusal to give password to the police would not constitute an offence of obstruction.

COVID-19 Updates (2/4)

At the time of writing, 961,725 cases of the coronavirus had been confirmed worldwide with 49,165 deaths. The US, Italy and Spain continue to be the most affected countries by the pandemic.

Confirmed cases in the US have exceeded 200,000.

Confirmed cases in Spain have exceeded 100,000. The death toll has also exceeded 1000. More than 6000 new cases are confirmed today.

Only 35 new cases have been reported in China, 34 of them are imported cases according to the authorities.

First cases confirmed in Burundi and Sierra Leone.

CDC is considering changing its guidelines and suggesting all Americans to wear face masks.

Sources suggest American Intelligence pointed out the reported figures from China is forged.

Multiple American States such as Florida also implemented stay at home orders, 80% of the American population are restricted domestically.

Medical supplies in American hospitals have almost ran out, respirators are not able to function due to the lack of maintenance.

Almost 100 individuals onboard the American aircraft carrier USS Franklin D. Roosevelt has contracted the virus. More than 1000 sailors onboard have landed on Guam.

6.6 million Americans filed for unemployment benefits last week, recording a historical height.

Filipino President Duterte warned to kill those who don’t follow the authority’s anti-epidemic measures.

Lockdown in Italy has extended to 13th April.

Curfew would be implemented in Thailand starting from tomorrow.

Reported cases are rapidly increasing in Tokyo, transmissions in hospitals are being found.

37 cases have been reported in Hong Kong. The HKSAR government announced temporary closures for bars, taverns and several types of entertainment.

In China, 14 dead individuals who first revealed the coronavirus epidemic in Wuhan, including “the whistleblower” Dr Li WenLiang, were rated as martyrs by the Hubei government.

WHO director Tedros expects the number of confirmed cases would exceed 1 million within a few days.

Hong Kong Government Imposes Liquor Ban For 14 Days

With regard to the failure to contain the coronavirus, the Hong Kong Government gazetted a new anti-epidemic rule on April 2 that will be in effect the next day.

According to the new regulation, all bars and pubs have to close from 6pm onwards on April 3 for 14 days. The rule also applies to venues and restaurants that sell alcohol: The area concerned has to be closed.

Earlier, Chief Executive Carrie Lam explained the rationale of the measure by claiming that people would "take off their masks" and "become intimate after drinking".

Hong Kong Photographer Raises Fund for Hospital in Italy

Hong Kong critically-acclaimed photographer Lam Yik-fai was invited to join another 99 photographers from around the world to participate in a fund-raising campaign for a coronavirus-stricken hospital in Bergamo, Italy.

Lam donated an iconic photo he took last November during the police attack of the Chinese University of Hong Kong. Another photographer chose a photo he took in Sham Shui Po, Hong Kong in 2006.

With 7.5% of its population infected, Bergamo is one of Italy's town most hit by the coronavirus.

Taiwan has been donating masks around the world.

The Chairman of the European Union thanked Taiwan for donating 5.6 million face masks to Europe.

The French Bureau in Taiwan (Bureau Français de Taipei, BFT) also expressed gratitude to the Taiwan government and Taiwan president Tsai Ing-wen.

Police Arrest Flag Waving Taxi Passengers for 'disorderly behaviour in public place'

On 31 March, police arrested 2 male and 1 female taxi passengers for 'disorderly behaviour in public space',
after they waved a flag that read "Liberate Hong Kong, Revolution of Our Times" on a taxi.

Not only that the police ordered the female civilian to apologize out loud for several times during the search and arrest; the police also scorned by telling the arrested civilians, "it costs to be cool".

Legal experts condemned the police for misusing and misinterpreting ordinance to make arrest.

Over 100 lawmakers around the world condemn HK government's cruel treatment of pro-democracy activists

#AndyLi, one of the 12 Hong Kong pro-democracy activists imprisoned in China, was transferred back to Hong Kong on Mar 22, 2021 after serving his sentence in China; however Li’s family has been unable to reach him for multiple days.

On Apr 2, 2021, the Inter-Parliamentary Alliance on China (#IPAC) issued a statement criticizing the Hong Kong government’s cruel and inhumane treatment towards Li and his family, and called for the release of Li and all pro-democracy activists that are detained unfairly.

Signatories of the statement involve national lawmakers from the UK, US, Canada, Japan, and different European countries, as well as IPAC’s advisors. The statement mentioned that, since Li’s transfer to Hong Kong after serving his 7-month sentence in Shenzhen, Li has been held in a single cell in a psychiatric facility without being able to get in touch with his family. The statement described Li’s treatment as “cruel, inhumane and shocking”.

Li’s case was also described as an “emblematic of the Chinese Government’s ruthless crackdown on Hong Kong’s way of life, and disregard for the international treaties designed to protect it.”. The signatories pledged to make urgent representation to their respective governments, and demanded Hong Kong government to release Li and all activists that are being detained unjustly.

Cherie Wong, the convener of Alliance Canada Hong Kong, an organizatiom fighting for the autonomy of Hong Kong, has been facing repeated death and rape threats.

For instance, in January 2020, even when she had a friend book her a hotel room in Vancouver under a different name, she received threats over the phone.

“I sat in my room and just started shaking, realizing that I could be in very real danger and not knowing what to do,” she said.

Wong said activists who are critical of the China often have their families in China visited by government officials.

“They come and knock on your door and say, ‘we’re coming in to talk to you about your family,’” she explained.

“What dissidents face in Canada is often on the grey area of criminal harassment and just discomfort that you feel (in) daily life,” Wong said.

In the recent emigration wave in Hong Kong, local comic artist “Maggie” announced on social media that she has immigrated to the UK. Although the reason for the move was not provided, netizens expressed regret.

“Maggie” Lau Ho Yan is a famous comic artist in Hong Kong. Some of her popular comic works include “My silly way” and “Our silly wedding”. Online game “Hong Kong-style cafe” is also based on her comics.

The public broadcaster RTHK has once again removed radio show content, citing "controversial material" as a reason.

In the radio progran “Letter to Hong Kong” scheduled to be aired on April 4, 2021, a letter that district councillor #MarkMo wrote to a detainee was originay planned to be read.

However, on Apr 2, 2021, Mo received a notification from RTHK that based on the new programme editor regulations, pre-approval is required before any controversial topic is put on the show and therefore his letter would not be read out on the show on Apr 4.

The show decided to read a letter written by previous chairman of RTHK Board of Advisors Chan Kin-keung.

According to Mo, he wrote the letter to a detainee that he visited for work reasons. The letter quoted some lyrics from Les Misérables, and mentioned that the democratic camp and the resistance camp are both facing challenges and are reflecting how they should keep going under Hong Kong’s current situation. He was not given a date when the letter will be read.

Lithuanian documentarian Mantas Kvedaravičius killed in Ukraine 

It was reported on April 4, 2022 that #Lithuanian documentary filmmaker #MantasKvedaravičius was killed in the besieged Ukrainian city of #Mariupol.

The Committee to Protect Journalists issued a statement, calling for those responsible to face justice:

“We extend our deep condolences to the friends and family of Mantas Kvedaravičius, who was killed while reporting from Mariupol, a city he had documented for years. His killers must be brought to justice.”

Ukraine’s Ministry of Defense, Director Vitaliy Manski wrote on Facebook that Kvedaravičius was killed “with a camera in his hand.”

In another statement, Lithuanian President Gitanas Nauseda said that Kvedaravičius “until the very last moment, in spite of danger, worked in Russia-occupied Ukraine.”
