📅 The Schools Of Thought Among Scholars Regarding The Calculation Of The Seven Days For The Aqīqah

Question: Allah blessed me with a daughter on Thursday, 14/7/2011, at 7:00, half an hour before the Maġrib prayer, and I slaughtered an ʿaqīqah for her on Thursday, 21/7/2011. Is this ʿaqīqah valid? May Allah reward you with goodness.

Answer:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, and upon his family and companions. To proceed:

Indeed, this ʿaqīqah is valid in any case, because it occurred after its occasion—which is the birth—took place. It also occurred on the day designated for it according to the Mālikīs (al-Mālikiyyah) and those who agree with them. This is because, in their view, if the birth occurs after dawn (fajr), the day of birth is disregarded.⁽¹⁾ Thus, it is not counted among the seven days mentioned in the statement of the Prophet ﷺ:
«كل غلام رهينة بعقيقته، تذبح عنه يوم سابعه، ويسمى فيه، ويحلق رأسه»
"Every newborn boy is pledged (rahīnah) to his ʿaqīqah, which is sacrificed on his seventh day, and he is named on it, and his head is shaved."

This is an authentic (ṣaḥīḥ) ḥadīth narrated by the compilers of the four Sunan.

The position of the majority of scholars (al-jumhūr) is that the day of birth is included in the seven days. Therefore, if the birth occurred on a Thursday, the ʿaqīqah would take place on the following Wednesday; whereas according to the Mālikīs, it takes place on Thursday. For further benefit, see the fatwas with the following numbers: 244671, 24831, 57957.

And Allah knows best.

------------------------------------
[1] Islamically, the new day begins after sunset. Mālikīs state that if a child is born after Fajr (dawn), then that day is not counted when calculating the seven days. In our example, the child was born 30 minutes before the new day (sunset). However, according to Mālikīs, this day is not counted because it is after the Fajr (dawn) time of the day. With the majority of scholars, though, this day is counted as the first day, even if it's only 30 minutes into it. In this case, the seventh day would be July 20th. In short, the majority view is that the day of delivery is counted as the first day without exceptions. (Note that days start after sunset.)

📝 Does Ordering Someone To Do What Is Forbidden (Ḥarām) Equate To Disbelief (Kufr)?

He asks, "Is commanding [someone to do] what is forbidden (ḥarām) considered disbelief (kufr)?"

Answer: No, it is not considered disbelief.

Meaning, if a person commands someone else to commit a sin (maʿṣiyah), this act itself is not deemed disbelief unless they personally deem that forbidden act to be permissible (istaḥallahu) or believe that it is an obligatory duty. In that specific case, it is considered disbelief stemming from the category of creedal disbelief (al-kufr al-iʿtiqādī).

This is because disbelief is divided into four distinct categories:

1️⃣Disbelief through words (kufru-l-aqwāl)
2️⃣Disbelief through actions (kufru-l-afʿāl)
3️⃣Disbelief through beliefs (kufru-l-iʿtiqādāt)
4️⃣Disbelief through polytheism (kufru-sh-shirk)

Question:
[Questioner] says, O honorable Shaykh, is selling idols to someone who worships them considered apostasy (riddah) from Islām?

Answer:
No, it is not considered apostasy unless he intends that and desires to spread shirk (polytheism). However, it is among the greatest of major sins (kabā’ir), and the prohibition of this has been explicitly established in text. Therefore, it is not permissible to sell an idol to someone who worships it, as it constitutes assisting in shirk. A person's motive in doing this may simply be worldly gain (dunyā), not disbelief (kufr) nor assisting in shirk. If this is his intention, he has committed a grave crime, but he is not a disbeliever (kāfir). He must repent and return to his Lord, Jalla wa-‘Alā (the Exalted and Majestic).

❓ ❝ Praying at home without a valid excuse is the practice of the hypocrites. It has never been reported from any Companion that they granted leeway to miss congregational prayer without an excuse; rather, the reports transmitted from them regarding its obligation in the mosque are overwhelming and mutawātir (mass-transmitted). ❞

✅ Is Wearing Solid Red Cloths Prohibited?

Ḥadīth:
Abū Juḥayfa said: I saw Bilāl giving the adhan, turning his face from side to side with his fingers in his ears, while the Prophet ﷺ was in a red leather tent. Bilāl came out with the ʿanazah (a short spear) and planted it in the flat groud, and the Prophet ﷺ prayed facing it. A dog and a donkey passed in front of him. He wore a red ḥullah. [Abū Juḥayfa added] it was as if I could see the gleam of his shins. [The narrator] Sufyān (al-Thawrī) added: I think it was a ḥibara. (a striped Yemeni cloth).

In his explanation of the ḥadīth, our Shaykh Al-Saʿd said:

❝ ...Likewise, the red ḥullah (a matching set of upper and lower garments) is mentioned. This issue is also disputed, namely wearing (solid) red clothing, and the views on it reach seven or eight. As I recall, or as I think, al-Ḥāfiẓ Ibn Ḥajar mentioned eight views. The preponderant (rājiḥ) view, and Allah knows best, is that red clothing is only disliked (makrūh) and not forbidden (ḥarām). It is established in this hadith that the Messenger of Allah ﷺ wore a red ḥullah.

Some have answered this by saying that "red ḥullah" means one in which red predominates, not one that is purely red, as Ibn al-Qayyim, may Allah have mercy on him, and others held. Al-Shawkānī and others disagreed. They said the Companion described it as a red ḥullah without any exception. The closer view, and Allah knows best, is al-Shawkānī's: the ḥullah was red. That is the apparent wording of the ḥadīth, and we do not resort to figurative interpretation (taʾwīl) without evidence. We know of no clear evidence for what Ibn al-Qayyim said. This is perhaps the closest view (to what is correct) on the issue: red clothing is disliked.

However, if the garment has redness together with other colours, such as white, then according to the preponderant view it is not disliked. But if the ḥullah or garment is purely red, it is only disliked, because the Prophet ﷺ prohibited it. This is reported in many ḥadīths, perhaps as many as twenty. Yet this ḥadīth (in question) indicates that the earlier prohibition is one of dislike (karāhah), not unlawfulness (taḥrīm). This is how the ḥadīths are reconciled. ❞

— Al-Shaykh Al-Muḥaddith ʿAbdullah Al-Saʿd (audio)
~ Galandān 🖋️

----------------------------
Note: The Shaykh stated in another place: “Perhaps the most correct view in this matter is that red clothing is permissible (jāʾiz), based on the ḥadīth of Al-Barāʾ ibn 'Āzib that the Messenger of Allah ﷺ wore a red ḥullah. So, the preferred view is that it is permissible, but the better course is not to wear it—that is the primary recommendation. Otherwise, the underlying basis of permissibility is that it is indeed permissible.”

The second issue: Women wearing red

“It is permissible for women to wear red by the consensus (ittifāq) of the four jurisprudential schools: the Ḥanafī, Mālikī, Shāfiʿī, and Ḥanbalī schools, and it is the view of a group from the Salaf. ”
