However, the Supreme Court ordered a retrial in the original court, and his requests to perform an alternative civilian service have been ignored. A Supreme Court case lodged by Christian conscientious objector Andrii Vyshnevetsky – still forcibly held in the army – continues. He argues that failure to determine a procedure for dismissal from military service on the basis of conscientious objection is illegal.

Occupation forces broke the Catholic church's windows and door during a raid, claiming they were looking for explosives and drugs. Artyom Sharlay of the Russian occupiers' Religious Organisations Department claimed to Forum 18 that "law-abiding" religious communities "face no restrictions, but those that break the law are banned".

45-year-old Seventh-day Adventist Dmytro Zelinsky is serving his 3-year jail term for refusing mobilisation on grounds of conscience, and is due to arrive soon in a Kolomyia prison. On 28 August, Ternopil Appeal Court acceded to Prosecutor Roman Harmatiuk's request to overturn his June acquittal. Harmatiuk did not respond to Forum 18 to say why he appealed against the acquittal. Zelinsky is preparing a Supreme Court appeal. Courts have handed conscientious objectors 3 prison sentences (2 of them later overturned), 9 suspended prison terms, and 2 acquittals (which prosecutors are challenging). Seven criminal trials continue.

On 15 February, the bruised body (possibly with a bullet-wound to the head) of 59-year-old Fr Stepan Podolchak of the Orthodox Church of Ukraine was found in the streets of Kalanchak in Russian-occupied Kherson Region. The morgue called his wife to identify him. The occupation forces, who seized him two days earlier, "tortured Fr Stepan to death", says Kherson Bishop Nikodim. Forum 18 asked Kalanchak's Russian police what action they will take following his killing. "For a long time this [community] hasn't existed here and won't," the duty officer replied. "Forget about it."

On 5 March, the parliamentary Committee on Humanitarian and Information Policy stated that a draft Law targeting the Ukrainian Orthodox Church (UOC) for Russian links is ready for second reading, no date for which has been set. Without careful consideration and redrafting to remove the numerous human rights problems in the current draft, the Law would not implement Ukraine's legally-binding international obligations to respect and protect the freedoms of religion or belief, expression, and association.

At a hearing at the Russian-controlled Crimean Supreme Court in Simferopol on 2 August, Zaporizhzhia Regional Court jailed 41-year-old Ukrainian Orthodox priest Fr Kostiantyn Maksimov in a strict regime labour camp for 14 years on "espionage" charges. "I'm in such shock," his mother Svetlana Maksimova told Forum 18. He is likely to be illegally transferred to Russia after any appeal. On 15 August, a verdict is expected in the criminal trial of Olena, a Protestant from Melitopol facing up to 10 years' imprisonment for remarks at a prayer meeting.

Clerics and believers of the Ukrainian Orthodox Church (UOC, affiliated with the Moscow Patriarchate) have and are facing criminal charges of justifying Russian aggression and hate speech. Many have been prosecuted for criticising the rival Orthodox Church of Ukraine and the state's religious policies. The state faces a real threat of the utilisation of religion to justify Russian aggression, but uses tools - imposing a blatant ban on the UOC and turning inter-Orthodox relations in Ukraine into a security issue - that are neither reasonable nor proportionate.

Law No. 3894-IX banning the Russian Orthodox Church – Moscow Patriarchate (ROC) and Ukrainian religious organisations affiliated with the ROC comes into force on 23 September. Its main target is the Ukrainian Orthodox Church (UOC). While addressing real security concerns over the ROC's involvement in Russian aggression, the Law does not comply with legally-binding international standards of freedom of religion or belief, and significantly increases State powers to arbitrarily monitor and restrict religious communities and the expression of religious ideas. Government, public and private actors already see it as a signal to attack UOC communities and believers.
