Advocate = Member of Bar Council of India, License to Practice Law

Lawyer is generic word

As per clause 4

Reg 53B partnership with member of bar council of India is allowed

Further with qualified people also partnership is possible so with LLB also it is possible

So basically partnership is allowed with both.

Can questions of capital adequacy again coms in sep 25 in ca final audit ?

Answer is very much yes icai repeated ale related questions in back to back attempts same can happen to capital adequacy and prudential norms so don’t leave them.

Doubt . As per clause 4 part 1 Second schedule a CAIP is cannot do audit of trust if partner are trustee / employee but under ESB he can stat. audit even if he is member of that trust ( unless any prohibition by statute govern trust) . Sir what we do in this case i cannot understand even he is member he can do audit ? sir pls clear this doubt thank you

Trustee — Manages Trust
Employee — Works For Trust Under Trustee
Member — Is beneficiary of trust.

1st & 2nd cannot do audit of trust
3rd can do audit
as there could be 1000s of members and many get disqualified so they have shown leniency as majorly suchy things are for charity
