Nicolás Maduro's legal team asked a federal judge in New York to force the Office of Foreign Assets Control (OFAC) to release Venezuelan state funds, arguing that the former leader lacks his own resources to pay for the trial.

Attorney Barry J. Pollack sent a letter on February 20, 2026 to Judge Alvin K. Hellerstein to complain about the blocking of the accounts.

In the court document, the defense argued that the economic sanctions violate the constitutional rights of the defendant.

"Venezuela would do it, and Mr. Maduro cannot pay a lawyer otherwise," the legal firm justified in the text.

The defenders accused the US agency of sabotaging the process by denying access to the Caribbean nation's public coffers.

"By not allowing the Venezuelan government to pay for Mr. Maduro's defense costs, OFAC interferes with Mr. Maduro's ability to retain a lawyer and, therefore, with his right to a lawyer of his choice under the Sixth Amendment," the firm claimed in court.

According to Reuters, sources familiar with the matter told the international media that the cancellation of the agreements has not affected Venezuela's oil and gas production so far.

The governments of Venezuela and the United States are examining the credentials of the companies that signed those contracts. Similarly, some of these companies are little known and the agreements were signed while Venezuela was under US sanctions.

The contracts under scrutiny include projects that have recently started producing oil in high-demand areas such as Lake Maracaibo, large projects aimed at expanding production in the Orinoco Oil Belt, and small mature oil fields.
