Dr Mark Hobart gives an update of his legal proceedings and what he really wants people to be aware of...
"...Basically, I want it to be widely known that Department of Health Officers do not have the legal right to enter a doctor's clinic and take patient's clinical notes. It is illegal. They are trying to say it is legal now under the Memorandum of Understanding between AHPRA and the Department of Health, and under Schedule 5 of the National Law, which does not make it legal either. And we must stop this because you'll just have these government officers taking private and confidential patient files from their doctors and using them how they see fit, which, in my experience, is not very good at all.
The other thing is that the government, AHPRA board cannot tell doctors how to behave. They are not
doctors, they just tell doctors how to behave for political reasons. And that was exemplified in the COVID
situation here, where doctors were told not to tell patients anything which might undermine the COVID vaccine rollout." (Dr Mark Hobart).
