Fingal County Council has served an enforcement notice on Unit 29, Airways Industrial Estate, Santry after the commercial unit was found to be in breach of fire safety and other regulations despite currently accommodating 228 asylum seekers, reports the Business Post.

In May, gardaí broke up a peaceful protest by elderly locals to force asylum seekers into the building, destroying their camp in the process.

Last November, the Department of Housing announced that planning permission would not be needed to convert buildings to house refugees for the next two years.

Now building regulators around the country are struggling to enforce crucial safety regulations, partly because the planning exemption means developers do not need to submit a commencement notice to local authorities if they are carrying out works to an existing house to make it fit to house refugees.

In an enforcement notice served on Gateway Integration Ltd, the company that converted the Santry unit into refugee accommodation, the council said the building had been occupied without compliance with a number of parts of the building regulations.

Fingal County Council ordered the company to take steps to rectify the non-compliances and threatened to seek a court order if this did not happen within five weeks.

Gateway Integration Ltd told the Business Post that the unit at Airways Industrial Estate “is being used as emergency accommodation to house asylum seekers at a time where there is significant pressure on the international protection system”.

“Further work has been ongoing to address all issues raised and to ensure full compliance. Some of this has already been completed.”

Kadima Mbuye, 53, an asylum seeker from the Congo who has been living in Ireland for nine years, was charged at a special sitting of Newcastle West Court in Limerick on Sunday with intentionally engaging in offensive conduct of a sexual nature.

A patient in University Hospital Limerick recovering from major surgery last March said she was terrified after the Congolese man allegedly broke into her room in the middle of the night and started masturbating in front of her.

“She said she was scared to scream as she couldn’t physically move due to her surgery. She was terrified he was going to attack her,” said Detective Garda Fiona O'Connell.

Mbuye denies the charge but was denied bail.

In 2021, Mbuye was accused of threatening staff with a knife at the Travelodge Hotel in Ballymun.

His defence solicitor had told the court he was in discussion with the Dept of Justice in relation to voluntary repatriation but that it was a complex and lengthy process.

Kadima Mbuye is the same asylum seeker who blamed his food being spiked with "sex tablets" for exposing himself in front of people at the Mount Trenchard direct provision centre in Foynes in 2019.

The manager of the centre told the court:

“He was flashing his penis. I reported it to Garda Elaine Freemantle. She took the CCTV off me. There were a lot of other occasions. A lot of residents and a bus driver complained to me that he was flashing his penis.

“I told him it was a bad act and sexual harassment. He kept doing it. He was transferred to Mount Trenchard because the same matter was happening at other locations.”

Mbuye was given a probation bond for 12 months with the condition he would not expose his genitals in public.

Concerns raised in Mountrath, co. Laois after locals learn that a family home on the Portlaoise Road has been offered to IPAS to accommodate between 36 and 54 asylum seekers.

Independent Cllr James Kelly told Laois Today that he believes the property should not be considered or included in the programme for accommodation.

“The terms and conditions of the agreed Exempted Development with IPAS states that as the property is not zoned commercial or retail, and is zoned residential, the owners will have to apply for planning permission.

“I also cannot comprehend how a residence that was a home for one family is now been classed as suitable for 36 persons which on my information could expand to 54 persons.

“I have had numerous conversations in this county with the central theme being that owners of these accommodation centres are only in it for the profit and not for the good of the refugees or the local towns, villages and their residents.”

Gardaí raiding the James McSweeney House at 10 Berkeley St in Phibsborough last night.

Since May 12th, members of the Trotskyist 'Revolutionary Housing League' have been using asylum seekers to squat in the building after their camp was dismantled by locals on Sandwith St.

However, last Thursday a judge ordered gardaí to arrest and bring before the High Court all persons who were refusing to vacate the property which is owned by the Cabhrú Housing Association who want to redevelop it as housing for the elderly.

Previously, a judge had refused to order the arrest of the occupants due to a lack of evidence about their identities. However counsel for Cabhrú said they have since given copies of the court order to vacate to anyone entering or leaving the building in six different languages, but said it was impossible to identify the occupants as they have been covering their faces with masks.
