Dealing With Refusals - CVR FOIAs

If your county is refusing to hand over the CVR data, and you also sent them a version of Jeff's template (You can find the explanation here and the template here).

Here is some legal counsel we received for what to do next:

Per Federal law, election data has to be retained for 22 months from election before it can be destroyed. The date for data destruction is September 3, 2022, and you can bet election boards across the nation are itching for that date to show up.

Well, falling back on my military indoctrination that you never throw a problem on the table without bringing a potential solution, let me give you one here (it's not a guarantee to stop evil actors, but it should give most pause) which I humbly suggest you all point out to any and all groups involved in auditing or canvassing the 2020 election:

Everyone knows that you can make a FOIA request (or whatever it might be called under your state's law). Many of these boards are going to deny or only partially answer your requests - they'll probably find an excuse to keep damning records from you.

When that happens, you of course have the right to pursue litigation or whatever administrative remedy process that may exist under your state's laws. WHEN YOU RECEIVE A DENIAL, SERVE A "PRESERVATION OF RECORDS" NOTICE LETTER ON WHOEVER DENIED YOU ACCESS, AS WELL AS THE BOARD, THE BOARD'S CLERK/SECRETARY AND BOARD MEMBERS INDIVIDUALLY. ALSO CHECK THE BOARD'S WEBSITE TO FIND OUT IF A PARTICULAR PERSON IS NAMED TO RECEIVE SERVICE. SEND IT TO THAT PERSON, TOO. Do this ASAP after denial.

I suggest using the "shotgun" approach to service - use multiple methods including hand delivery at a board meeting (typically recorded/video), certified mail, email, etc. That way, you've covered your bases when it comes to making sure the right folks have gotten notice.

Keep in mind that you should act in good faith and follow through with a lawsuit to get the records, if necessary. Those types of lawsuits aren't hard, and typically a lay person can do them. You should be able to find templates for retention of records notice letters, and lawsuits, for your state. Be sure to identify every record you want to access including any records you've requested that may require redaction.

The cast vote records are the sequential data that encompasses the digital audit trail of the election.

There are many states that are still unwilling to give up their cast vote records as required by the Help America Vote Act of 2002.

And here is why...

The BAR is working against the People. (We have the Law on Our Side.)

AND

The CVR's have shown that their was intentional scripting of the selection process across the USA and the current election equipment has been compromised.

This data is directly from the Public source, so anyone should be able to run this same data and get the same results.

Time to wake up. The "fix was in" and it still is.

We must go back to handcounts and we can do that with the Help America Vote Act as well.
