The SCOTUS decision was "unpublished". It's a fairly recent legal tactic courts invented to screw over one party, but not make it legal precedent to be used later screw over people they don't want. It's done under the guise the facts in the case are so unique, they could never possibly apply in any other circumstance.

So Pennsylvania is violating the spirit, but not the letter of the earlier SCOTUS decision.
