Russian Soldiers Once Again Commit Grave War Crime

Earlier this week, pro-war Russian Telegram channels circulated a video depicting the execution of Ukrainian prisoners of war. The footage, nearly four minutes long, shows Russian soldiers assaulting positions held by the Armed Forces of Ukraine, directed by a commanding officer who monitors their progress from a UAV. A minute into the video, two Ukrainian servicemen, attempting to surrender, emerge from a dugout. The recording clearly shows they are unarmed and have visibly given up the fight, but the assault troops open fire anyway. The soldiers then finish off the wounded with a grenade and a burst of gunfire from an assault rifle.

It is worth noting that the war crime occurs under the direction with the unequivocal approval of the commanding officer. His off-screen instructions leave no doubt about his role in directing the fighting. The same voice during the execution repeatedly gives explicit orders: “Take no prisoners, shoot them all!”

According to the Geneva Conventions of Aug. 12, 1949, no parties to a conflict may refuse to take a surrendering enemy into captivity. Article 3 of the Geneva Convention relative to the Treatment of Prisoners of War states: “Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely <...>.
To this end the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons:
(a) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture.”

Our team has geolocated the site of the shooting of the Ukrainian POWs. It is a tree line along the railway branch, 1.5 kilometers east of the village of Klishchiivka (48°31'37.5"N 37°58'53.7"E). Based on the geolocation, we can conclude that the video was filmed recently, as active fighting has been ongoing in this area for the past few months. It is likely that the shooting may have been carried out by the soldiers of the 6th Motorized Rifle Division or units attached to it. This particular division actively publishes combat footage from the Klishchiivka area.

This is not the first video showing the shooting of surrendering or captured soldiers. For example, in December 2023, the Ukrainian side released video recordings of similar war crimes allegedly committed by soldiers of the Russian 76th Guards Air Assault Division in the Robotyne area. However, the case under discussion is distinguished by clear indications from the commander, which do not allow attributing the incident to soldiers committing a crime contrary to their commander’s intentions. It clearly demonstrates that the intentional commission of serious war crimes is the modus operandi of Russian troops, stemming from, and at the very least, encouraged by local military command.

The Office of the Prosecutor General of Ukraine has initiated a criminal case regarding the violation of laws and customs of war, coupled with intentional homicide.
