Justice Ketanji Brown Jackson defended the βBlack Codesβ used to restrict freed slaves in the South as constitutionally admissible precedent.
When the US Principal Deputy Solicitor General Sarah Harris called the laws βobvious outliersβ in violation of the Constitution, Justice Brown retorted that they were admissible for their time.
Harris pointed out that the laws were never constitutional and Jackson accused her of not caring about history.
