Shaykh ibn baz rahimahullah was asked :

السؤال: يباع هنا في أمريكا لحوم مثلجة ومبردة، ولا ندري من ذبحها، ولا كيف ذبحت. فهل نأكل منها؟

Question:

Here in America, frozen and chilled meats are sold, and we do not know who slaughtered them or how they were slaughtered. Is it permissible for us to eat from them?


الجواب: إذا كانت المنطقة التي فيها اللحوم المذكورة ليس فيها إلا أهل الكتاب من اليهود والنصارى، فذبيحتهم حلال، ولو لم تعلم كيف ذبحوها؛ لأن الأصل حل ذبائحهم؛ لقول الله : الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ وَطَعَامُ الَّذِينَ أُوتُواْ الْكِتَابَ حِلٌّ لَّكُمْ وَطَعَامُكُمْ حِلُّ لَّهُمْ الآية [المائدة:5].

فإن كان في المنطقة غيرهم من الكفار فلا تأكل؛ لاشتباه الحلال بالحرام، وهكذا إن علمت أن الذين يبيعون هذه اللحوم يذبحون على غير الوجه الشرعي؛ كالخنق والصعق، فلا تأكل -سواء كان الذابح مسلمًا أو كافرًا- لقول الله : حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالْدَّمُ وَلَحْمُ الْخِنْزِيرِ وَمَا أُهِلَّ لِغَيْرِ اللّهِ بِهِ وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ إِلاَّ مَا ذَكَّيْتُمْ الآية [المائدة: 3].

وفق الله المسلمين للفقه في الدين، إنه سميع قريب

Answer:

If the area where these meats are available is inhabited solely by the People of the Book from the Jews and Christians, then their slaughtered meat is permissible to eat, even if you do not know how they slaughtered it. This is because the default ruling is that their meat is lawful, as Allah says (meaning):

“This day good food (tayyibaat) has been made lawful for you, and the food (ie sacrifices) of those who were given the Scripture is lawful for you.” Al-Ma’idah:5

However, if there are others in the area besides the People of the Book—such as idol worshippers or atheists—then do not eat the meat, due to the uncertainty between what is lawful and unlawful.

Similarly, if you know that those selling the meat kill in a manner not according to Islamic sharia, such as by strangulation or electric shock, then do not eat it, regardless of whether the slaughterer is Muslim or non-Muslim. This is based on Allah’s statement (meaning) :

“Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and those killed by strangling, or by a violent blow, or by falling, or by the goring of horns, and those from which a wild animal has eaten—except what you slaughter (before death)” Ma’idah:3

May Allah grant Muslims understanding in their religion. Indeed, He is All-Hearing and Near (in answering our prayer)
