APPEAL TO THE EUROPEAN COURT OF JUSTICE CONCERNING THE
'5G' TENDER
Appeal for financial support

Dear friends and colleagues,

With this message we inform you of the development regarding our appeal in the 5G NETWORK
INSTALLATION tender in Greece:

The hearing took place on 14 January 2022 in the plenary session of the Council of State.
The Council of State rejected our appeal (announced on 07/24 and posted with the full text on
11/24) by the majority of its judges.
There was a minority of judges in favour of our positions.

The decision, in the opinion of our lawyer Prof. George Balias and his colleagues abroad, suffers
from a clarity issue, contains ambiguities and leaves gaps. These allow us to hope for our vindication
at the European Court of Human Rights (Strasbourg, France) which is our only option if we want
to proceed to the next legal step.

Theoretically, the European Court of Human Rights operates as an
independent court, it does not have the same constraints or pressures that a national court may have.

What are the facts?
1. It is the first court decision in Europe to be finalised on the 5G issue so it will be the first to go to
the European Court of Justice if we go ahead.
2. Our statistics show that a small but not negligible percentage of appeals are upheld.
3. The cost for our legal coverage (by Mr. Ballia) is 5000 Euros.

We are in the process of seeking financial support from institutions and organisations. We believe
that it is our duty to exhaust all the possibilities offered by the European authorities to protect the
health of citizens and the environment, which are threatened by the installation and operation of 5G
networks in almost all of Greece.
