It's worth mentioning that the legislation does not directly state these elements, but it adopts the definition of "Antisemitism" from the International Holocaust Remembrance Alliance (IHRA).

It has been championed by the ADL since 2005. The ADL itself admits that such definition opposes the 1st Amendment of the US constitution on their website:

it is important to note that some of the examples of antisemitism included in the IHRA Definition, particularly those related to Israel, are protected speech under the First Amendment of the U.S. Constitution. That means that the government may not prohibit such speech or abridge it, including by conditioning penalties upon its exercise or benefits upon its suppression.
