🛑 The guidance also addresses how, for persons of exceptional ability seeking an NIW, that exceptional ability must relate to the endeavor proposed as part of the NIW request. We determine the relationship of exceptional ability to the proposed endeavor on a case-by-case basis, considering any shared skillsets, knowledge, or expertise.

🛑 In addition, this new guidance provides information about how we evaluate whether a proposed endeavor has national importance and explains how we evaluate evidence, such as letters of support and business plans, when determining whether a person is well positioned to advance an endeavor.

### ✳️ نکات مهم این فرمان:

✅ ارائه فهرست کشورهای "غیرهمکار" در ۶۰ روز:
ترامپ از چهار مقام ارشد دولتش خواسته تا ظرف دو ماه، لیستی از کشورهایی تهیه کنند که با دولت آمریکا در بررسی پیشینه متقاضیان ویزا همکاری نمی‌کنند. انتظار می‌رود کشورهایی مانند ایران، یمن، سومالی و سودان در این لیست باشند.

✅ امکان اخراج مهاجران از کشورهای غیرهمکار:
بر اساس این فرمان، وزارت امنیت داخلی می‌تواند شهروندان کشورهای غیرهمکار را که پس از ۲۰ ژانویه ۲۰۲۱ وارد آمریکا شده‌اند، اخراج کند.
واژه‌ی "Alien" در این فرمان به همه‌ی افراد غیرشهروند آمریکا اشاره دارد، حتی دارندگان گرین کارت! با این حال، کارشناسان حقوقی معتقدند اخراج دارندگان گرین کارت با چالش‌های حقوقی مواجه خواهد بود.
👤 اما پناهندگان، دانشجویان و دارندگان ویزاهای موقت، در برابر این فرمان آسیب‌پذیرترند. این افراد باید از هرگونه رفتار یا تخلف که ممکن است جرم تلقی شود (حتی جرایم رانندگی جزئی) خودداری کنند.

### 🚫 دستور اجرایی ترامپ برای ممنوعیت ورود شهروندان ۱۲ کشور از جمله ایران 🇺🇸

در تاریخ ۴ ژوئن ۲۰۲۵، دونالد ترامپ، رئیس‌جمهور ایالات متحده، با صدور یک فرمان اجرایی جدید، ورود اتباع ۱۲ کشور از جمله ایران، افغانستان، سومالی، لیبی و یمن را به خاک آمریکا ممنوع اعلام کرد. این تصمیم از تاریخ ۹ ژوئن لازم‌الاجرا خواهد بود و شامل افرادی می‌شود که در خارج از آمریکا هستند و تا آن زمان ویزای معتبر ندارند.
