We never stop learning new things about Cast Vote Records.

Clear Ballot systems can produce both cast vote records and ballot images at the same time in the same folder. This is why some Clear Ballot counties have been so obstinate in their claims that Cast Vote Records can reveal the voter's choices - they are conflating the Cast Vote Records with the Ballot Images. (Ballot images don't reveal anything about the voter either unless the voter puts their name or signature on the ballot, in which case they are voluntarily "opting out" of voter secrecy. I have seen rulings of this going back even before 2020).

So, here's what you do for Clear Ballot Counties that are nonresponsive.

You include this in the Records Request.

"Your system may export Cast Vote Record files and Ballot Images as separate files in the same export. In these cases, there will be two files for each ballot, identically named except for the fact that Cast Vote Record filenames end with "c" and Ballot Image files and with "i". As this request is for Cast Vote Records only, it applies only to the files ending with "c", which cannot possibly contain any information linking that ballot to an individual voter".

If you request both Cast Vote Records and Ballot images, alter the above to make it clear that the two types of data should be considered separately in their availability and fee decisions.
