India has introduced new criminal laws to replace the Indian Penal Code (IPC), Criminal Procedure Code (CRPC), and Indian Evidence Act (IEA). This historic overhaul aims to modernize and streamline the legal framework, ensuring it aligns with contemporary needs and values. The reform promises a more efficient and just legal system, reflecting the changing dynamics of Indian society.
The CrPC of 1973 will be replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023.
• The Indian Evidence Act of 1872 will be replaced by the Bharatiya Sakshya Bill, 2023.
▪ Indian Penal Code would be replaced by Bharatiya Nyaya Sanhita, 2023
The key reforms in the new Indian criminal laws include:
1. Simplification and Modernization: The laws are updated to be more comprehensible and relevant to contemporary issues.
2. Victim-Centric Approach: Enhanced focus on victim rights and support, including compensation and protection.
3. Speedy Justice: Provisions for faster trials and reduced delays in the judicial process.
Technology Integration: Increased use of technology for evidence collection, documentation, and trial processes.
5. Community Policing: Emphasis on community involvement in crime prevention and law enforcement.
6. Stronger Penalties for Heinous
Crimes: Harsher punishments for severe offenses such as terrorism, sexual crimes, and organized crime.
7. Gender Sensitivity: Improved laws addressing gender-based violence and discrimination.
8. Revised Bail Provisions: Clearer and fairer bail procedures to prevent misuse.
9. Decriminalization of Minor Offenses: Focus on major crimes by decriminalizing minor infractions and introducing alternative measures for them.
