Was the NM Supreme Court’s Writ of Mandamus defective?

The Writ of Mandamus applies to non-discretionary, mere ministerial acts. Election certification is a discretionary act based on a commission’s judgment that the election is worthy of certification.

“the judges of the election would thereby be compelled to perform a task ... which involves the exercise of judgment and discretion, not a mere ministerial act within the ordinary function of a writ of mandamus.” Hall v Stuart, 198 Va. at 326, 94 S.E.2d at 291 (1956).

Have to hit the road later today and swing through several New Mexico counties being threatened with prosecution for withholding certification for elections being held on uncertifiable and illegal voting systems.

I rarely have a clue how commissioners will respond to this kind of tyranny. But I believe faith activates God’s power. So the Buick and I will drive on in faith.

The Unselect Committee has been unable the answer, or in any way refute, the detailed statement, put out yesterday, of voter fraud and irregularities in numerous states that took place in the 2020 Presidential Election. They don’t answer because they have no answer. All they say is it is “the BIG LIE,” when actually it is the BIG LIE in reverse. Every major decision on election certification, whether it be Joe, Kamala, or Jill, results in visits just days before. Her electronic tracker is so restrictive that she is prevented from reaching the other side of the house to cook on the wood stove. She cannot go outside to play with her grandchildren.

On the Otero County Commission’s decision to withhold certification.

“[Commissioner] Griffin said “his position hasn’t changed since Monday.”

“Whenever I call in my vote, it is going to remain the same and that is going to be a ‘No’ on the certification,” he said.

“[Commissioner] Marquardt, who during the June 13 meeting said she does not trust the machines, said her opposition to certification had nothing to do with the 2020 presidential election, but with if irregularities occurred in last week’s primaries. She cites a race for a then-District 2 seat on the commission where two candidates in the Republican primary are separated by only 11 votes and that three of those votes came from places where there once were homes but are now vacant lots.”
