Just an FYI...

The legal offence criminalising the creation (and request for creation) of intimate images without consent including AI generated/deepfakes, was already included in the Data (Use and Access) Act 2025, which became law in June 2025.

The offence will be brought into force this week, meaning they will start enforcing it.

So the news isn’t that the UK just invented this new law - it’s 'activating and prioritising enforcement of a law' that already exists.

In UK law, an Act often doesn’t automatically come fully into force on Royal Assent. Instead, specific provisions are brought into force by a commencement order (a type of statutory instrument) which is issued by the relevant Secretary of State.

The offence is detailed under Section 138 of the Data (Use and Access) Act 2025.

The relevant offence is inserted into the Sexual Offences Act 2003 as amended by the Data (Use and Access) Act 2025.

The new offence is in s. 66E (and linked s. 66F) of the Sexual Offences Act 2003, as amended by the 2025 Act.

The offence can apply wherever in the world the creator or the request comes from (extraterritorial reach) as stated in s. 66F.

Including if a person intentionally creates an intimate image of another adult without consent, whether or not the image is actually generated.

This captures AI generated images, including deepfakes, where the person depicted did not consent.

The term 'purported intimate image' includes images or videos that 'appear to be of a person in an intimate state.'

The offence as currently drafted is a summary offence, meaning:

Up to the maximum term for summary offences in England & Wales (typically up to 51 weeks imprisonment) and/or a fine.

This does not cover the creation of purported intimate images of children, as the criminal law already captures the making of indecent images including deepfake images of children (those under the age of 18) in s. 1 of the Protection of Children Act 1978. UK child-protection law was written broadly enough that it already captures AI and deepfakes...
