Today's order by the Delhi High Court on the NEET PG Cut off reduction case.
The learned counsel for the respondent states that the file for relaxing the percentile is under submission. Subject to the decision on the same the respondent will also seek extension for the third round of counselling. She states that since if the percentile is reduced the relief sought in the present petition will not survive for consideration. She therefore requests that the matter be taken up on the 3rd Jan of 2025.
Respondent here is Union of India in the case (MoHFW and NMC are under UoI)

Our inferences from the discussion and the arguments / submissions today
1) Cut off reduction file is with the Ministry for approval
2) Expected that on 2nd Jan a decision might be taken by the Ministry (meaning Ministry of Health and Family Welfare which has to decide on the cut off reduction and notify through MCC)
3) If a decision is taken (an approval is provided by the Ministry) - then a representation for 3rd round counselling and further changes in the schedule will be requested (and notified)
So likely that we are going to see a delay of a week or a few days extra in the schedule.
Queries
1) Will choice filling for AI round 3 start now?
Not sure about this. We expect choice filling to be delayed.
However choice filling may even start for the current set of eligible candidates. And then later they can extend and allow fresh regn and a few more days. Will have to wait for notification of timelines. In any case CHOICE FILLING WOULD END LATER (delayed by a few days at least) as per revised schedule that will be published. Basically keep looking at notifications.
2) Will cut off be reduced? Will there be fresh registration for reduced cut off based eligible candidates before AI round 3?
Going by the submissions of Union of India in today's case - looks so. Cut off is expected to be reduced within the next few days. May be by Jan 2nd as they have almost confirmed in the court. Registration will open again for reduced cut off based eligible candidates and they can fill choices for AI round 3
3) How much will the cut off be reduced by/to ?
No idea. Unless the internal file submitted to the Ministry is somehow available, there will be no confirmation on this. Everyone will just keep guessing. Just wait for notifications
4) Will AI Round 2 joined seat resignation timeline be extended (especially for Telangana)?
This has no relevance to the cut off reduction case. However given that the choice filling is not starting (Telangana) candidates can request for a resignation timeline extension (no disadvantage since there is already a minimum 3-4 days delay expected for the cut off reduction decision).
Process of cut off reduction
1) Cut off Reduction decision has to be taken by Ministry of Health and Family Welfare - NMC Act allows MoHFW to modify cut offs. NMC will further publish a notification on cut off reduction after Ministry approves the file.
2) Post this NBE will notify the cut off reduction (being the examination body)
3) Post this MCC will notify the revised counselling schedule
Indian to NRI conversion is pending as well. Looks like a week's wait now.

Discussion
1) The counsel for Union of India mentioned that the reduction in cut off has been approved and the percentile has been reduced (committed to the court).
2) The petition has been disposed off (since the prayer in the petition has been granted - cut off has been reduced)
The exact reduction - no idea. Should be notified in a day or two.

Pursuant to the previous order of 30th Dec 2024 - Counsel for the respondents states that the decision for relaxing the existing percentile has been taken by the competent authority and has been approved. The percentile having been reduced for issues of admission through the concerned Medical process for the MD/MS/DNB courses for NEET PG counselling 2024, the Counsel for the petitioner says the grievance has been addressed. Accordingly the petition stands disposed off taking note of the statement made by counsel for the petitioner.
Summary:
1) Cut off reduction is confirmed. AI 3rd round will happen after cut off reduction
2) MCC has extended the AI Round 2 resignation deadline till 8th January 2025 6 pm (now accommodating for Tel, Rajasthan and may be MP round 2 results too)
Process of cut off reduction
1) MoHFW will notify NMC through a letter to implement Cut off Reduction with a copy to NBE
2) Post this NBE will notify the cut off reduction (being the examination body)
3) We will have a revised AI vs State Schedule (both AI timelines and state timelines modification from round 3)
4) MCC will notify the revised counselling schedule for AI round 3 (starting from fresh regn where reduced cut off based eligible candidates can register).
Note: If you are already eligible and looking for fresh registration, please register now itself. Don't wait till the revised schedules. Registration might still be open for all even later, but why take a chance!!
5) AI Round 3 Choice filling will start for all. Expecting this to start after Jan 8th (Unlikely but please check notifications daily (just in case they start even earlier)
States related confusion (What we Expect)
1) Some states like UP, Goa etc - even though it was very clear that the AI counselling is delayed - have gone ahead and published schedules. Some have published their State R2 resignation deadlines to be by 8th January 2025 (UK) etc.
2) We expect that all these states will modify their state r2 resignation deadlines and state schedules as per
the revised AI vs State Schedule (both AI timelines and state timelines modification will be notified). Once you have the revised schedules published by NMC or in MCC portal - the changes will be communicate by these states. In any case if there is a process now in any of these states - please go ahead (like let us say Goa says send across choices - please send them.
