◆Recently Beijing has introduced various changes in Hong Kong, which is under China’s Special Administrative Region, Thus taking away the autonomy which Hong Kong had.
✔️Hong Kong position
◆Hong Kong, which is under China’s Special Administrative Region (SAR), has served as the mainland’s most important gateway to the world for the past 24 years.
◆After the end of British rule in 1997 in Hong Kong, it lost its expectations that it would have a unique identity of its own.
◆Unlike the mainland, the unique “one country, two systems” model guaranteed the residents of Hong Kong- a high degree of autonomy and freedoms, free press, the right to protest, and a rambunctious political scene with a noisy pro-democracy opposition and an independent judiciary, which is a stark contrast from the Communist Party-controlled courts across the border.
◆However, recently the Standing Committee of China’s National People’s Congress (NPC), approved Various changes to Hong Kong’s electoral system, thus reducing the share of directly elected representatives in the SAR’s Legislative Council(LegCo.).
◆President Xi Jinping has recently signed orders to promulgate amendments to Hong Kong’s Basic Law, governing the SAR and it shall be the biggest change since 1997.
✔️Amendments proposed
●Earlier,35 out of 70 LegCo’s members were directly elected, and now that number has been reduced to 20, even if the size of the legislature has been expanded to 90.
●The remaining 70 shall be nominated from pro-establishment groups, thereby ensuring a majority for the pro-Beijing camp in perpetuity. Further, Beijing has also established a Candidate Eligibility Review Committee to decide the eligibility of candidates and deem whether they are “patriotic” enough.
●These amendments cannot be challenged in the courts, though it's an independent institution.
●Beijing has justified the amendments as a move to ensure “patriots” were administering Hong Kong and it was responded in response to the 2019 protest movement, which was silenced by last year’s stringent national security law.
●The protesters in 2019 demanded universal suffrage, which was promised to them during the 1997 handover.
●The protest movement had wide backing was clear in the 2019 district council elections, after which the pro-democracy camp ended up with 90% of the seats.
●However, with recent amendments, the district councilors will have no place either in LegCo or in the Election Committee.
●With the new amendments and the national security law in place, Beijing’s grip on Hong Kong is tighter than ever.
✔️Conclusion
◆Beijing through its political framework may have succeeded in assuaging the business community’s concerns with the continued attraction of the mainland’s market, however, it is far closer to winning the hearts and minds of Hongkongers.

◆Delhi Netaji Subhas University of Technology Bill, 2015 introduced in the assembly was returned by the President of India to the legislative assembly of Delhi on January 17, 2017. The same was conveyed to the Lieutenant Governor.
◆The reason for return was the inconsistent definition of the term “Government.”
◆In June 2015, when the Legislative Assembly of Delhi had passed the Delhi Netaji Subhas University of Technology Bill and sent it for the President’s assent, the term “Government” was defined as the “Government of the National Capital Territory of Delhi.”
✔️Formalizes the definition
●The Delhi Assembly once again sent a modified version of the Bill for the President’s assent where the term “government” was described as: “Lieutenant Governor of NCT Delhi appointed by the President.”
●Recently, both the Houses of Parliament voted in favor of the amendments to the Government of the National Capital Territory (NCT) of Delhi Act.
●The amendments aimed to resolve ambiguities in the roles of various stakeholders and provide a constructive rule-based framework for stakeholders of the Delhi Government to work in tandem with the Union Government.
●One of the important amendments was to bring consistency in the definition of the term “Government”.
●In this instance, not only formalized the term government which was already accepted. by Delhi government but it stresses providing a rule-based framework as Delhi being the national capital and the symbolism that comes with being the seat of the sovereign power.
✔️Partners not adversaries
◆The National Democratic Alliance Government, under the leadership of the Prime Minister, has completely transformed Centre-State relationships.
◆The transformation focuses on that States and the Chief Ministers of the States are partners in the national agenda and focus on providing platforms and frameworks to work together.
◆During the period of earlier governments, the State Chief Ministers were queuing up in front of unelected officials, the Planning Commission supplicating for grants.
◆However, the creation of NITI Aayog, the introduction of the Goods and Services Tax Council, restructuring of central schemes, and accepting the Fifteenth Finance Commission’s recommendations for greater devolution are clear examples of the Union Government viewing States as equal partners.
✔️A legislative right
◆To enhance this partnership further, there is a need for an environment of trust and cooperation, which requires distinct delineation of roles and responsibilities, the removal of ambiguities, and the definition of a clear chain of command among stakeholders.
◆Hence it became important to define, who represents the Government in the unique case of Delhi.
◆In 1991, Home Minister S.B. Chavan tabled the Constitution Amendment Bill in the Lok Sabha to add Articles 239AA and 239AB into the Constitution which paved the way for the creation of a Legislative Assembly and a Council of Ministers for the National Capital Territory (NCT) of Delhi.
◆These amendments of 1991 enabled the Government of NCT Delhi to enact laws regarding matters specified under the State list and Concurrent list, to the extent these are applicable to a Union Territory also empowering parliament to supplement constitutional provisions.
◆There needs to be complete synchronization between the Union Government and the Government of NCT Delhi to avoid encroachment in legislative matters.
◆The Delhi government has no legislative competence in matters pertaining to the police, public order, and land.
◆However, the attempt for increased encroachments on these subjects by the Legislative Assembly of Delhi may have severe ramifications for Delhi.
●Thus, the Opposition portraying that the government exercising its constitutional responsibilities is an undemocratic act displays a willful lack of understanding by the opposition.
