LGBTQIA+ Community in India[1/2]

✓In recent years, several countries, including India, have legally recognized third sex and homosexuals as equal citizens, after a long struggle of several different movements and protests around the world.

✓The Preamble of Indian Constitution recognises its citizens impartially as "We the people of India" and ensures justice - social, economic, and political.

✓In September 2018, in the review of Section 377 of Indian Penal Code, the Supreme Court gave the judgment to decriminalize adult consensual same-sex marriages.

✓This decision is considered a landmark, both in terms of its expansive interpretation of constitutional rights and in terms of empowering LGBTQIA+ community.

✓While it was a big achievement, it does not mean that LGBTQIA+ people in India are absolutely free or treated equally to their fellow citizens.

✓It undermines the amount of work that remains to be done in India and around the globe.

‼️What does LGBTQIA + Stands For?

✓While no term can fully capture the spectrums of genders and sexual identities in the world. LGBTQIA+ mainly stands for: Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, Asexual, and more

⁉️What is the History of Recognition of LGBTQIA+ In India?

✓Ancient India was about acceptance and celebration of all forms of love and neutrality to the idea of homosexuality.

✓Visual example is the Khajuraho Temple of Madhya Pradesh, showcasing the existence of sexual fluidity between homosexuals.

✓In 1861, Britishers considered sexual activities “against the order of nature” including all homosexual activities were criminalized under section 377 of the Indian Penal Code.

✓In 1977, Shakuntala Devi published the first study of homosexuality in India, called “The World of Homosexuals”.
It called for “full and complete acceptance and not just tolerance and sympathy”.

✓In 1994, they were legally granted voting rights as a third sex.

✓In 2014, the Supreme Court of India ruled that transgender people should be treated as the third category of gender.

✓In 2017, the Supreme Court gave the country’s LGBTQ community the freedom to safely express their sexual orientation.

✓An individual’s sexual orientation was protected by the Right to Privacy.

✓On 6 September 2018, the Supreme Court struck down the part of Section 377 which criminalized consensual homosexual activities.

✓In 2019, Parliament enacted Transgender Persons (Protection of Rights) Act with an objective to provide for protection of rights of transgender people, their welfare, and other related matters.

Which Cases have Helped the LGBTQIA+ Community Get Their Rights Acknowledged?

🔹Navtej Singh Johar Vs. Union of India: The SC held that Article 14 of the Constitution guarantees equality before law and this applies to all classes of citizens.
It restores ‘inclusiveness’ of LGBTQ Community and homosexuality was decriminalised.

🔹Shafin Jahan Vs. Asokan K.M. and Others (2018): In this case, the SC observed that choice of a partner is a person’s fundamental right, and it can be a same-sex partner.

🔹National Legal Services Authority Vs. Union of India (2014): The SC observed that “recognition of transgenders as a third gender is not a social or medical issue, but a human rights issue”.

‼️What are the Problems Faced by LGBTQIA+ Communities in India?

🔸Marginalisation: LGBTQIA+ individuals may experience multiple forms of marginalisation-such as racism, sexism, poverty or other factors – alongside homophobia or transphobia that negatively impact their mental health.

✓Often, such marginalisation leaves LGBTQIA+ people without access to the basic services such as medical care, justice and legal services, and education.

LGBTQIA+ Community in India[2/2]

🔸Impact of Family Reactions on LGBT Children: Rejection and serious negative reactions kept many LGBTQIA+ youngsters from telling their parents about their feelings.

✓In a society bound by a rigid set of social and cultural norms that dictate the terms and conditions of education, career and marriage, the lack of family support can prove to be a big blow to the mental and physical health of LGBTQIA+ people.

🔸Unheard Rural Voices: The voices of urban LGBTQIA+ people are heard through several online and real-world platforms.

✓Whereas rural LGBTQIA+ people often suppress their feelings due to a lack of exposure, comfort and internet connectivity in their area because their refusal to marry brings more physical abuse.

🔸Homelessness: Most of the homeless LGBTQIA+ youth are thrown out of their homes for being queer, or they ran away to escape an abusive situation.

✓They miss out on education and social support during critical formative years.

✓And without any economic support, they often engage in drug use and risky sexual behaviors.

🔸Problems of Terminology: LGBTQIA+ people are labelled with negative stereotypes and made fun of, thereby robbing them of their goal of getting recognition and making them feel socially excluded.

🔸Socially Unrecognised: School uniforms, dress code and appearance, access points for travel (including ticket booking forms, security screening and toilets) are often gendered.

✓Frequently, LGBTQIA+ individuals are forced to negotiate their gender identity in public while on public transportation.

🔸Lack of Employment Opportunities: Difficulties in obtaining accurate gender identity documents, including school records, adversely affect employment prospects.

✓Discriminatory eligibility requirements place gender restrictions on some jobs, which effectively exclude transgender and gender non-binary persons from getting the job.

What Should be the Way Forward?

🔹Changing Social Attitude Toward LGBTQIA+ People: As TV and movies are accessible to rural populations where social media has not yet penetrated, they are likely to be the best tools for redefining family roles and attitudes through programs and stories that educate and enlighten, as well as relay LGBTQIA+ experiences in authentic and diverse ways
Movies like Badhaai Do, Shubh Mangal Zyada Saavdhan, Aligarh can play a big role in changing the negative attitude of society towards LGBTQIA+ Community.

🔹From Special Treatment to Equal Treatment: LGBTQIA + people don't seem to be aliens, they're not sick and their sexual preference is innate and being homosexual is a normal phenomenon and not a disease.

✓They deserve to be treated equally, not specially and once they are included in Indian society as equals, they will get fully blended in collective development.

🔹Gender Neutrality: There is a need to treat all genders as equal with none discrimination.
It conjointly means policies, language, associated social behaviour should avoid characteristic roles per an individual’s gender.

🔹Towards Better Parenting: Fundamental responsibility of any parent to accept their children’s identity.

✓It is by accepting the child that they will transform society into one that values diversity and accepts the uniqueness of each individual.

🔹Awaring and Empowering LGBTQIA+ Youth: An open and accessible forum is needed so they feel recognized and comfortable sharing their feelings.

✓Platforms like Gaysi and Gaylaxy have helped carve out spaces for LGBT people to interact, share and collaborate.

✓The Pride Month and Pride Parade Initiative is also a good step in this direction.

ONDC and It's Potential [1/2]

✓The government’s efforts to use technology to make e-commerce more competitive are beginning to show up in food delivery services.

✓Customers are reporting noticeable price differences in orders placed on online apps using the Open Network for Digital Commerce (ONDC), which creates a network of interconnected e-marketplaces that makes it easier for small store-owners to tap demand online.

✓It could be a game-changer on the lines of the Unified Payments Interface (UPI), the infrastructure on which digital transactions are growing in this country exponentially.

‼️What is ONDC?

🔹About:

✓It was launched in late 2021 under the Department for Promotion of Industry and Internal Trade (DPIIT) by the Ministry of Commerce as part of the Digital India push.

✓ONDC works as a network of interconnected e-marketplaces through which sellers, including brands, can list and sell their products directly to customers bypassing any middlemen or intermediaries.

✓Along with food delivery, ONDC also offers delivery services for groceries, home decor, cleaning essentials, and other products.

🔹Objectives:

✓Democratisation and decentralization of e-Commerce
Inclusivity and access for sellers, especially small and medium enterprises as well as local businesses
Increased choices and independency for consumers
Making goods and services cheaper

🔹Working Mechanism:

✓ONDC functions on the basis of an open network where it will not be a single platform similar to Amazon or Flipkart but rather in the form of a gateway where buyers and sellers across different platforms will be able to connect.

What are the Potential Advantages of ONDC?

🔸Increased Transparency:

✓ONDC can provide greater transparency by making government data more accessible to the public.This can help increase trust and accountability.

🔸Increased Customer Choice:

✓ONDC has the potential to dilute market concentration by increased consumer choice and lower entry barriers.

🔸Innovation:

✓ONDC can spur innovation by providing entrepreneurs and researchers with access to government data.

✓This can lead to the development of new products and services that benefit society.

🔸Cost Savings:

✓ONDC can save money by reducing duplication of effort and enabling more efficient use of resources.

✓Platform fees for food delivery using ONDC are being reported at a fifth of those charged by the market leaders. This is a considerable reduction in the cost of intermediation.

🔸Protecting the Consumers’ Interest:

✓By breaking the hegemony of existing e-commerce, ONDC can bring huge benefits to consumers.

🔸Level Playing Field:

✓ONDC is keen to level the playing field for e-commerce operators and widen the digital market access for Micro, Small and Medium Enterprises (MSMEs) and small traders in the country.

🔸Neutral and Regulated Platform:

✓ONDC aims at fostering open networks developed on open-sourced methodology, using open specifications and network protocols, and independent of any specific platform.

ONDC and It's Potential [2/2]

⁉️What are the challenges ahead?

▪️Complexity: ONDC is a complex mechanism as compared to other systems like UPI. People found UPI's convenience appealing, which made them adopt it. The same may not be true for ONDC.

✓People have already become accustomed to the user interface of existing companies.

▪️Increase in Disputes: In ONDC, only the buying and selling process happens online, while the delivery and use of the product happens offline.

✓This can lead to more disputes as ONDC is not an intermediary platform.

▪️Lack of a Robust Grievance Addressal Mechanism: The lack of clarity on responsibility for customer service and handling complaints may deter people from joining the platform.

▪️Not an Easy-Peasy Task: The existing e-Commerce companies have deepened up ties with the consumers through their lucrative and interoperable services.

✓Like Amazon provides its streaming platform along with its prime membership.So, it’ll not be easy for the ONDC to attract the customers.

▪️Goods & Services may not be Really Cheaper: Since ONDC is a facilitator of trade among buyers and sellers, it may not be able to provide offers the products like existing players.

For Example, Amazon has tied up ICICI bank to provide 5% cashback on goods purchases through Amazon ICICI Credit Card.

⁉️What should be the Way Forward?

✓A better digital space for e-commerce must be built by the government in order to compete with the dominant e-commerce platforms.

✓Along with this, it's important to create a proper digital education policy that takes into account various languages and user-friendly interface for the benefit of the consumers as well as sellers.

✓A massive, well-funded adoption campaign will be needed to bring over small sellers like kirana stores to the platform.

✓The demand and supply sides should be able to access a secured single window to resolve issues such as information asymmetry, opaque pricing, quality concerns, and buyer-seller disputes.

Mechanism:
There should be a secured single window to navigate both the demand and supply-side problems like information asymmetry, opaque pricing, quality and product concerns and buyer-seller conflict.

Aatmanirbharta’ in Defence: MoD approves 4th Positive Indigenisation List of 928 strategically-important Line Replacement Units/Sub-systems/Spares & Components

✓To promote ‘Aatmanirbharta’ in defence & minimise imports by Defence Public Sector Undertakings (DPSUs).

✓Raksha Mantri Shri Rajnath Singh has approved 4th Positive Indigenisation List (PIL) of 928 strategically-important Line Replacement Units (LRUs)/Sub-systems/Spares & Components, including high-end materials & spares, with import substitution value worth Rs 715 crore.

✓Details of these items are available on SRIJAN Portal (https://srijandefence.gov.in/). These will only be procured from the Indian Industry after the timelines indicated in the list.

✓This fourth list is in continuation to the previous three PILs involving LRUs/Sub-systems/Assemblies/Sub-assemblies/Spares & Components which were published in December 2021, March 2022 and August 2022 respectively.

✓These lists contain 2,500 items which are already indigenised and 1,238 (351+107+780) items which will be indigenised within the given timelines. Of 1,238, 310 items (1st PIL - 262, 2nd PIL - 11, 3rd PIL - 37) have been indigenised, so far.

✓The DPSUs will undertake indigenisation of these items through different routes under ‘Make’ category and in-house development through the capabilities of MSMEs and private Indian industry, thereby providing impetus to the growth in economy, enhanced investment in defence and reduction in import dependence of DPSUs.

INDIA-INDONESIA BILATERAL EXERCISE SAMUDRA SHAKTI - 23

✓INS Kavaratti, indigenously designed & built ASW Corvette, arrived at Batam, Indonesia to participate in the 4th edition of India-Indonesia Bilateral exercise Samudra Shakti-23 from 14-19 May 23.

✓An Indian Navy Dornier Maritime Patrol aircraft and Chetak helicopter is also participating. The Indonesian Navy will be represented by KRI Sultan Iskandar Muda, CN 235 Maritime Patrol Aircraft and AS565 Panther Helicopter.

✓Exercise Samudra Shakti is aimed at enhancing interoperability, jointness and mutual cooperation between both the navies.

✓The Harbour phase will comprise Cross deck visits, professional Interactions, Subject Matter Expert Exchanges, and sports fixtures.

✓During the Sea Phase, weapon firing, Helicopter Operations, Anti-submarine warfare & air defence exercises and boarding operations are planned.

✓Samudra Shakti -23 will showcase the high level of interoperability between the two navies and their shared commitment towards peace and stability in the region.

LGBTQIA+ Community in India[1/2]

✓In recent years, several countries, including India, have legally recognized third sex and homosexuals as equal citizens, after a long struggle of several different movements and protests around the world.

✓The Preamble of Indian Constitution recognises its citizens impartially as "We the people of India" and ensures justice - social, economic, and political.

✓In September 2018, in the review of Section 377 of Indian Penal Code, the Supreme Court gave the judgment to decriminalize adult consensual same-sex marriages.

✓This decision is considered a landmark, both in terms of its expansive interpretation of constitutional rights and in terms of empowering LGBTQIA+ community.

✓While it was a big achievement, it does not mean that LGBTQIA+ people in India are absolutely free or treated equally to their fellow citizens.

✓It undermines the amount of work that remains to be done in India and around the globe.

‼️What does LGBTQIA + Stands For?

✓While no term can fully capture the spectrums of genders and sexual identities in the world. LGBTQIA+ mainly stands for: Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, Asexual, and more

⁉️What is the History of Recognition of LGBTQIA+ In India?

✓Ancient India was about acceptance and celebration of all forms of love and neutrality to the idea of homosexuality.

✓Visual example is the Khajuraho Temple of Madhya Pradesh, showcasing the existence of sexual fluidity between homosexuals.

✓In 1861, Britishers considered sexual activities “against the order of nature” including all homosexual activities were criminalized under section 377 of the Indian Penal Code.

✓In 1977, Shakuntala Devi published the first study of homosexuality in India, called “The World of Homosexuals”.
It called for “full and complete acceptance and not just tolerance and sympathy”.

✓In 1994, they were legally granted voting rights as a third sex.

✓In 2014, the Supreme Court of India ruled that transgender people should be treated as the third category of gender.

✓In 2017, the Supreme Court gave the country’s LGBTQ community the freedom to safely express their sexual orientation.

✓An individual’s sexual orientation was protected by the Right to Privacy.

✓On 6 September 2018, the Supreme Court struck down the part of Section 377 which criminalized consensual homosexual activities.

✓In 2019, Parliament enacted Transgender Persons (Protection of Rights) Act with an objective to provide for protection of rights of transgender people, their welfare, and other related matters.

Which Cases have Helped the LGBTQIA+ Community Get Their Rights Acknowledged?

🔹Navtej Singh Johar Vs. Union of India: The SC held that Article 14 of the Constitution guarantees equality before law and this applies to all classes of citizens.
It restores ‘inclusiveness’ of LGBTQ Community and homosexuality was decriminalised.

🔹Shafin Jahan Vs. Asokan K.M. and Others (2018): In this case, the SC observed that choice of a partner is a person’s fundamental right, and it can be a same-sex partner.

🔹National Legal Services Authority Vs. Union of India (2014): The SC observed that “recognition of transgenders as a third gender is not a social or medical issue, but a human rights issue”.

‼️What are the Problems Faced by LGBTQIA+ Communities in India?

🔸Marginalisation: LGBTQIA+ individuals may experience multiple forms of marginalisation-such as racism, sexism, poverty or other factors – alongside homophobia or transphobia that negatively impact their mental health.

✓Often, such marginalisation leaves LGBTQIA+ people without access to the basic services such as medical care, justice and legal services, and education.

🔸Impact of Family Reactions on LGBT Children: Rejection and serious negative reactions kept many LGBTQIA+ youngsters from telling their parents about their feelings.

✓In a society bound by a rigid set of social and cultural norms that dictate the terms and conditions of education, career and marriage, the lack of family support can prove to be a big blow to the mental and physical health of LGBTQIA+ people.

🔸Unheard Rural Voices: The voices of urban LGBTQIA+ people are heard through several online and real-world platforms.

✓Whereas rural LGBTQIA+ people often suppress their feelings due to a lack of exposure, comfort and internet connectivity in their area because their refusal to marry brings more physical abuse.

🔸Homelessness: Most of the homeless LGBTQIA+ youth are thrown out of their homes for being queer, or they ran away to escape an abusive situation.

✓They miss out on education and social support during critical formative years.

✓And without any economic support, they often engage in drug use and risky sexual behaviors.

🔸Problems of Terminology: LGBTQIA+ people are labelled with negative stereotypes and made fun of, thereby robbing them of their goal of getting recognition and making them feel socially excluded.

🔸Socially Unrecognised: School uniforms, dress code and appearance, access points for travel (including ticket booking forms, security screening and toilets) are often gendered.

✓Frequently, LGBTQIA+ individuals are forced to negotiate their gender identity in public while on public transportation.

🔸Lack of Employment Opportunities: Difficulties in obtaining accurate gender identity documents, including school records, adversely affect employment prospects.

✓Discriminatory eligibility requirements place gender restrictions on some jobs, which effectively exclude transgender and gender non-binary persons from getting the job.

What Should be the Way Forward?

🔹Changing Social Attitude Toward LGBTQIA+ People: As TV and movies are accessible to rural populations where social media has not yet penetrated, they are likely to be the best tools for redefining family roles and attitudes through programs and stories that educate and enlighten, as well as relay LGBTQIA+ experiences in authentic and diverse ways
Movies like Badhaai Do, Shubh Mangal Zyada Saavdhan, Aligarh can play a big role in changing the negative attitude of society towards LGBTQIA+ Community.

🔹From Special Treatment to Equal Treatment: LGBTQIA + people don't seem to be aliens, they're not sick and their sexual preference is innate and being homosexual is a normal phenomenon and not a disease.

✓They deserve to be treated equally, not specially and once they are included in Indian society as equals, they will get fully blended in collective development.

🔹Gender Neutrality: There is a need to treat all genders as equal with none discrimination.
It conjointly means policies, language, associated social behaviour should avoid characteristic roles per an individual’s gender.

🔹Towards Better Parenting: Fundamental responsibility of any parent to accept their children’s identity.

✓It is by accepting the child that they will transform society into one that values diversity and accepts the uniqueness of each individual.

🔹Awaring and Empowering LGBTQIA+ Youth: An open and accessible forum is needed so they feel recognized and comfortable sharing their feelings.

✓Platforms like Gaysi and Gaylaxy have helped carve out spaces for LGBT people to interact, share and collaborate.

✓The Pride Month and Pride Parade Initiative is also a good step in this direction.
