Canada's business immigration landscape got materially harder in 2026. Here's what we told the Legal 500.

Four things every founder and employer moving talent into Canada should know right now:

1. The front door narrowed. The Start-Up Visa closed to new applications on January 1, 2026. The Self-Employed Persons Program is paused until 2027. PR admissions are stabilized at 380,000 a year, with a target of bringing temporary residents below 5% of the population by end-2027.

2. LMIA-exempt is now the default, not the fallback. Intra-company transfers, the C11 owner-operator permit, and the Global Talent Stream (two-week processing target) are faster, cheaper, and more reliable than the LMIA route for most business cases.

• Self-Employed Persons Program remains paused until further notice

What this means: the federal door is nearly shut for now. The pathways still processing are provincial entrepreneur streams, C11 owner-operator work permits, and intra-company transfers for businesses expanding into Canada.

• The federal Start-Up Visa has been closed to new applications since December 31, 2025
• The promised 2026 federal entrepreneur pilot still has no published eligibility criteria
• The 2026–2028 Levels Plan cut federal business immigration from 1,000 to 500 principal applicants per year

Why it matters: provincial entrepreneur streams are currently the open door — and BC's cut-off is stable enough to plan against. Score your file on BC's grid before you register, then close the gaps deliberately.

WORK PERMIT HOLDERS CAN NOW STUDY WITHOUT A STUDY PERMIT

• IRCC published a new temporary public policy on September 9, 2026.
• Who it covers: anyone holding a valid Canadian work permit.
• What changed: you may study a program of 6 months or less even if it extends past the period of stay authorized on your initial entry.
• Old rule (IRPR 188(1)(c)): the program had to finish inside that first authorized stay, or a study permit was required.
• In effect: September 4, 2026 → December 31, 2027. Revocable at any time, without notice.

Why it matters for business owners: owner-operators on C11 permits and ICT transferees can now take short certifications, compliance courses and executive programs without a second application.

Check your permit validity and confirm your program is genuinely six months or less before you enrol.

Context: Canada plans to admit 60,000 TFWP workers in 2026, down from 82,000 in 2025. Only 23,190 arrived in the first half of the year — 42.1% fewer than the same period last year.

What to do with this: none of these figures include the advertising period. Low-wage roles now require eight consecutive weeks of advertising before you can file. Plan backwards from your start date, not forwards from today — and check the Global Talent Occupations List before defaulting to a standard LMIA.
