🌄 Good Morning!
⚖️ Yesterday, the Supreme Court heard arguments on the extent of courts' power to modify arbitral awards. The Union government argued that under the Arbitration Act, 1996, courts can only remit or set aside an award—not modify it.
🗣️ The Union further submitted that if Parliament had intended to grant courts the power to modify awards, it would have explicitly included such a provision. Meanwhile, respondents contended that the ability to partially set aside an award could also be interpreted as the power to modify it. More: https://bit.ly/4jZtOtW
