Fall Habig: Umfangreiches Plädoyer und berührendes Schlusswort

Mit dem Plädoyer des Wahlverteidigers Wilfried Schmitz wurde das Verfahren gegen den Arzt Heinrich Habig am Dienstag fortgesetzt. Der Verteidiger hat dabei mit der Corona-Politik ebenso wie mit dem Vorgehen der Staatsanwaltschaft abgerechnet.

Nachdem diese der Justitia (aus welchen Gründen auch immer) nicht dienende Richterin die Anweisung gegeben hatte, das - aufgrund der jeden durchschnittlich empathischen Menschen rührenden Schlussworte des angeklagten Arztes - applaudierende Pubblikum im Gerichtssaal zwecks Aufnahme der Personalien festzuhalten (von einer Sanktionierung hat sie dann aufgrund der Proteste abgesehen), war wohl klar, wie sie entscheiden würde. Ich wünsche diesem Arzt, dass er ein den rechtsstaatlichen, demokratischen und aufgeklärten Prinzipien entsprechendes Berungsverfahren bekommt.

In Sachen Heinrich-Habig hat das Landgericht Bochum soeben das Teilurteil über 207 Fälle verkündet.

Es hat Heinrich Habig verurteilt zu einer Haftstrafe von 2 Jahren und 10 Monaten, der Haftbefehl ist sofort zu vollstrecken.

Die Begründung des Urteils lässt sehr zu wünschen übrig. Es wurden lediglich Behauptungen aufgestellt, keine einzige Subsumtion vorgenommen. Für Rechtfertigungs- oder Entschuldigungsgründe gibt es nach Ansicht des Gerichtes keine Anhaltspunkte. Stattdessen wirft das Gericht Heinrich Habig eine "rechtsfeindliche Gesinnung" vor.

Vom Standpunkt eines Juristen kann ich nur sagen, dass dieses Urteil einen Tiefpunkt deutscher Justiz darstellt.

Given five Amish people died in Lancaster Country, PA, “the Amish died at a rate 90 times lower than the infection fatality rate of the United States of America.”

“Now, how is that possible?” @stkirsch asked. “It’s possible because the Amish aren’t vaccinated. And because the Amish didn’t follow a single guideline of the CDC,” he answered.

“They did not lock down. They did not mask. They did not social distance, They did not vaccinate, and there were no mandates in the Amish community to get vaccinated. They basically ignored every single guideline that the CDC gave us. Ignoring those guidelines meant a death rate 90 times lower than the rest of America.”
