राजस्थान सरकार भी प्रदेश में बढ़ते अपराधों पर लगाम लगाने के लिए महाराष्ट्र के ’माकोका’ (महाराष्ट्र कंट्रोल ऑफ ऑर्गेनाइज्ड क्राइम) की तर्ज पर राजस्थान संगठित अपराध नियंत्रण विधेयक ’राकोका’ पारित करवा रही है।
राकोका के प्रावधानों बड़े ही सख्त है। जिनके अनुसार...

2. जिन अपराधियों के खिलाफ पिछले 10 साल में एक से ज्यादा चार्जशीट पेश की गई हो और कोर्ट ने उन पर संज्ञान लिया हो। ऐसे अपराधियों को राकोका के दायरे में लिया जाएगा।
3. गैंग बनाकर अपराध करने वालों की प्रॉपर्टी को राज्य सरकार अपने कब्जे में ले लेगी।
4. कानून के मुताबिक, गैंगस्टर्स की प्रॉपर्टी या पैसा अपने पास में रखने वालों को भी सजा होगी।
5. राकोका में मुकदमा दर्ज करने से पहले रेंज के डीआईजी से मंजूरी लेनी होगी। डीएसपी स्तर का अफसर ही राकोका में केस दर्ज करेगा। चार्जशीट पेश करने से पहले एडीजी स्तर के अफसर से मंजूरी लेनी होगी।
6. राकोका के केस की सुनवाई के लिए अलग से कोर्ट होगा। राकोका लगने के बाद आसानी से जमानत नहीं मिलेगी
7.राकोका के मामलों की सुनवाई ओपन कोर्ट में करने की जगह बंद कोर्ट में की जाएगी।
8.गैंगस्टर्स और खतरनाक अपराधियों के खिलाफ गवाही देने वालों की पहचान गुप्त रखी जाएगी।
9. गवाह की पहचान सार्वजनिक करने वाले को एक साल तक की जेल और एक हजार रुपए तक का जुर्माना भी लगाया जाएगा।
10.अगर फिरौती के लिए दो या अधिक अपराधियों ने मिलकर किसी को धमकाया तो उस पर ’राकोका’ लगाया जाएगा। ऐसा करने वालों की प्रॉपर्टी और पैसा जब्त होगा।
11. अपराधी गैंग के प्रत्येक सदस्य के खिलाफ राकोका के प्रावधानों के अनुसार कार्रवाई होगी।
12. गैंगस्टर्स की मदद करने वालों को भी उम्रकैद होगी इस कानून में अपराधियों और उसके मददगारों के लिए माफी नाम की कोई चीज नहीं होगी।
13. गैंग बनाकर अपराध करने वाले अपराधियों को शरण देने वालों को कम से कम 5 साल की सजा और 5 लाख रुपए का जुर्माने का प्रावधान हो सकता है ।
14. गैंगस्टर्स के खिलाफ एक्शन के लिए नियमों में एसओपी भी बनेगी।
महाराष्ट्र ने सबसे पहले 1999 में अंडरवर्ल्ड को खत्म करने के लिए महाराष्ट्र कंट्रोल ऑफ ऑर्गेनाइज्ड क्राइम एक्ट (मकोका) बनाया था।
महाराष्ट्र सरकार के मकोका को देखते हुए साल 2002 में दिल्ली सरकार ने भी इसे लागू किया।
यही नहीं, इस कानून के अच्छे परिणामों को देखते हुए यूपी सरकार ने भी इसी तरह का कानून बनाया।
