RCW 29A.08.370 (updated 2023) says: if an ineligible person gets auto-registered through the Enhanced DL/ID process and later votes without “knowing” they were ineligible, the registration is treated as an authorized administrative act. It’s not evidence they claimed citizenship, and they’re largely protected from criminal charges. The record just gets quietly cleaned up later.

Then on July 15, 2024, the state flipped the switch to full opt-out AVR. Get an Enhanced license or ID → you’re automatically registered. You only get out if you receive the mailed notice and opt out within 15 days.

Now look at the numbers:
2020 alone: 31,000+ new registrations through DOL → 20,000+ ballots counted from those brand-new registrations.

Total 2020 – Aug 2026: 116,000+ new registrations → 78,000+ ballots from them.

A system that automatically adds people, makes it hard to opt out, and then protects ineligible voters from consequences if they cast a ballot is not “secure.”
