Proposed Regulatory Amendments
● The Ministry of Labour, Training and Skills Development is proposing amendments to Ontario Regulation 422/17 (General) that will impact the Ontario Immigrant Nominee Program’s Employer Job Offer: In-Demand Skills stream.
The proposed amendments would:
● Establish a new selection criterion that would require employers seeking an approval of a NOC 7511 (Transport truck drivers) employment position under the Employer Job Offer: In-Demand Skills stream to be registered with Ontario’s Commercial Vehicle Operator’s Registration (CVOR) system, and to demonstrate that they have a Carrier Safety Rating (CSR) of Excellent, Satisfactory or Satisfactory-Unaudited.
● Protect successful nominees and support public safety on Ontario highways as employers without an acceptable safety rating would be ineligible for approval.
● Increase operational efficiency of the OINP and promote applications from employers with clear business ties to the province, since employers will be required to have their vehicles plated in Ontario.
The amendments are now posted on Ontario’s Regulatory Registry for public consultation.

● require employers seeking an approval of a NOC 7511 (Transport truck drivers) employment position under the Employer Job Offer: In-Demand Skills stream to demonstrate that they have a valid Commercial Vehicle Operator’s Registration (CVOR) certificate and a Carrier Safety Rating (CSR) of Excellent, Satisfactory or Satisfactory Unaudited.
The amendment aims to:
● protect successful nominees and support public safety on Ontario highways as employers without an acceptable safety rating will be ineligible for approval
● promote applications from employers with clear business ties to the province, since employers will be required to have their vehicles plated in Ontario
The amendment is effective February 1, 2022.
The Ministry consulted on the development of this amendment using:
● internal and external stakeholder consultations
● a posting on Ontario’s Regulatory Registry

On December 8, 2021, the Ontario Immigrant Nominee Program updated the standard conditions and/or restrictions of approval for applicants for certificates of nomination and employment positions under the Employer Job Offer streams.
Nominees and employers must comply with all conditions. Failure to comply may result in the cancellation of your approval.
If you were nominated under an Employer Job Offer stream you must:
● continue to demonstrate on a reasonable basis an intention to reside in Ontario.
● be employed in the approved employment position as of the date of your nomination, if you are already working for the employer.
● apply for a work permit within six (6) months and begin working in the approved employment position within ten (10) months from the date of your nomination, if you are not already working for the employer.
● inform the OINP immediately in writing if you have not begun working in the approved employment position within ten (10) months from the date of your nomination.
● continue to be employed in the approved employment position during the nomination period (i.e. until you receive permanent residence). This means that your terms of employment must remain consistent throughout the nomination period, including your:
● employer
● position title and duties
● wage
● hours of work
● work location
● notify the OINP immediately in writing if there is a change in the nature of your employment, including any of the above terms of employment by contacting the OINP at ontarionominee@ontario.ca.
Your nomination may be cancelled if:

● the above conditions and/or restrictions are not met
● the employer withdraws your job offer
● you decline your job offer
● your employment is terminated either by you or the employer
If you are an employer approved for an employment position under an Employer Job Offer stream, you must:
● employ the nominee in the approved employment position as of the date of nomination if the nominee is already working for you.
● employ the nominee in the approved employment position within ten (10) months as of the date of nomination if the nominee is not already working for you.
● inform the OINP immediately in writing if the nominee has not begun working in the approved employment position within ten (10) months from the date of nomination.
● continue to employ the nominee in the approved employment position during the nomination period (i.e. until the nominee receives permanent residence). This includes the following terms of employment:
● position title and duties
● wage
● hours of work
● work location
● notify the OINP immediately in writing if you are no longer able to comply with any of the above conditions and/or restrictions by contacting the OINP at ontarionominee@ontario.ca.
The approval of the employment position and the nomination may be cancelled if:
● the above conditions and/or restrictions are not met
● you withdraw the job offer
● the nominee declines the job offer
● the nominee’s employment is terminated either by you or the nominee
Conditions of nomination are authorized under section 17 of the Ontario Immigration Act, 2015, S.O. 2015, c. 8 (Act). Failure to comply may result in the cancellation of the approval in accordance with section 18 of the Act.
