The NHI Act faces two Constitutional Court challenges over inadequate public participation.
If the BHF challenge succeeds, the entire legislative process must restart; if the Western Cape challenge succeeds, only part must be repeated. If both fail, the low participation bar could be endorsed.
Separately, the Court has already struck down the NHI’s Certificate of Need system as unconstitutional.
