FAQ: If government files a notice of appeal of an order, does it automatically mean they can stop implementing the order?
Answer: Note: even if the government gives notice of an appeal of an order, that does not mean that the government can stop implementing that order. To stop implementing an order, that would require what is called a “stay” of the implementation of the order, which would require judge approval.

#Dv2021 Note: I understand that there is a movement amongst some DV-2021 selectees to contact the court directly to express dissatisfaction with the Goodluck order. This effort is misguided.
For the last couple years, we have worked hard to establish the court's favorable view of DV selectees as hopeful, peaceful immigrants who deserve better. If we hope for the court to treat us well in the future, we must treat the court with respect.

#RaivBiden #DV2021 Update: Judge Chutkan has issued an order on the motion to clarify.
1. Defendants shall begin processing and adjudicating the 966 reserved fiscal year 2021 diversity visa applications as soon as it is reasonably feasible to do so. Defendants shall complete the processing and adjudication of those 966 applications by the end of fiscal year 2022.
2. Defendants shall report their progress via a status report on November 15, 2021 and continue reporting every 30-days thereafter until such time as all 966 diversity visa applications have been adjudicated.

#SunnyvBiden procedural update: government asked us for extension of their deadline to answer our complaint, which is separate issue from our PI motion, Rafael proposed they can have extension if they agree to file within 21 days of order on our PI motion. They agreed and Judge made it so.
(This 21 days is important because we have learned in past that once government gets a stay for filing their answer to complaint, it’s difficult to get them to commit to new deadline.)

I saw someone today suggest that the Immigrant Visa Backlog was decreasing, and that's not true. The backlog as of September 30 is actually .056% more than it was at the end of March 30.
