FAQ: When I file a mandamus lawsuit and the government files a motion to dismiss, is it over?

Answer: No! Since September, immigration attorneys have seen many judges sympathize with mandamus lawsuits filed by immigrant families against the State Department. In fact, judges have denied the government's motion to dismiss in 7 lawsuits (2 were our cases):
1. Mahmood v. Blinken, No. 23-1596, 2023 U.S. Dist. LEXIS 177638, (E.D. Pa. Sep. 28, 2023).
2. Zunier v. Blinken, No. 3:22-cv-217, (S.D. Oh. Sep. 22, 2023).
3. Iqbal v. Blinken, No. 2:23-cv-01299-KJM-KJN, 2023 U.S. Dist. LEXIS 201592, (E.D. Cal. Nov. 8, 2023)
4. Khan v. Blinken, No. 1:23-cv-1194-CAP (N.D. Georgia Nov. 9, 2023).
5. Salihi v. Blinken, No. 23-cv-718-MMA-AHG, 2023 U.S. Dist. LEXIS 206644 (S.D. Cal. Nov. 17, 2023).
6. Raouf v. United States Dep't of State, No. 23-cv-302-LM, 2023 U.S. Dist. LEXIS 207113 (D.N.H. Nov. 20, 2023).
7. Akbar v Blinken, No. 23-cv-1054-LL-BLM (SDCA Dec. 18, 2023).
FAQ: If am a DV2020/Gomez class member or Goodluck/Goh plaintiff, or DV21 potentially eligible for reserved visa in Rai, who is inside the US, will it be possible for me to get a green card in the US if we beat the appeal?

Answer: First, whether green cards through “adjustment of status” process in US will be available with the reserved visas in Gomez, Goodluck, Rai, and Goh is unknown.

When I last inquired about this question with government attorneys, they acknowledged the question is under consideration by the agencies involved - USCIS (part of DHS) and State Department, had not made a decision. Also, they will not make a decision on this question before the outcome of the appeal.

Even if we beat the Biden administration’s appeal, and USCIS agrees to allow adjustment of status based upon those reserved visas, you may face other ineligibility obstacles to getting a green card related to your presence in the US.

For example, adjustment of status is usually only possible for applicants who have existing lawful status. Also, lawful status is defined in such a way where manner of entry is a factor.

Further, if you accrue unlawful presence in the US (especially if more than 180 days), not only could it make adjustment of status impossible but also issuance of visa at embassy impossible. (That is because of the the 3-year and 10-year unlawful presence grounds of inadmissibility in INA 212(a)(9)).

Related, I want to speak to some misinformation in the media that suggest the U.S. southern border is “open,” when it is not open. Sadly, this misinformation is manufactured by Republican politicians and the news outlets who support them in order to cause alarm with conservative voters. While this misinformation is bad for democracy, the true victims are the migrants who are misled by it, and put themselves in danger or on paths that end in disappointment, in reliance on the misinformation.

Under current law, it is true asylum seekers can present themselves at the border to seek asylum, but that’s not a guarantee of admission. However, that is a dangerous procedure with often unknown obstacles. Also, for many who are admitted whose their asylum claims are ultimately denied, that can mean removal back to their home country. U.S Immigration and Customs Enforcement (ICE)conducts dozens of removal flights each week all across the world.
