Updated CEAC stats for #UAOvBiden plaintiffs. Only 3% of plaintiffs have visas in hand, so State has a lot of work to do to impress judge.

#DV2022 Government just made a filing in #Tesafaye where they admit they’ve been lying all along (for years) to everyone about the order that DVs are scheduled for interview.

#DV2020 #DV2021 Update: On July 22, 2022, the clerk for the appeals court posted this letter concerning oral argument format. Basically, there are dozens of attorneys representing thousands of DV2020 and DV2021 plaintiffs across multiple lawsuits whose appeals share this consolidated hearing. In the interest of efficiency, the appeals court does not want to hear from every attorney. We will confer with counsel in the other lawsuits and work on a response to this filing by the August 12 deadline.
#DV2022 Update: Another Morgan Miles declaration came in on one of our individual mandamus lawsuits Friday that provides KCC's latest info on DV interview scheduling.

#UAOvBiden #DV2022 Update: On Sunday night, Judge Chang issued an order denying plaintiffs’ motion for expedited discovery. This is not a disaster. Most preliminary injunction motions are decided with plaintiffs not even asking for discovery.
This just means the Judge does not need to see more evidence from the government beyond the forthcoming data that he has instructed them to supply in their upcoming reply brief in order to make a decision on the motion for preliminary injunction.

Answer: A cautious no. I say no is because issuance statistics show that total of Issued, In Transit, Ready, and AP is close to 54,850. (Embarrassed I just noticed this)
The cautious part comes because if you get interview but then your status goes to Refused, your allocated visa is surrendered and you must hope there’s another visa available to be re-allocated.
(Note: upon reflection, the observation (and math) above cannot be reconciled with fact that all UAO plaintiffs at NVC are already AV. So the fact that In Transit+Ready+AP+Issued=55k may not be significant - curtis)

Sunny/Santos/Wilson gov filing earlier this month shows Biden administration completely neglects immigrant visa interviews for Indian spouses & children of green card holders. Plaintiffs include 35 separated families waiting for US Embassy Mumbai who have been ready for interviews since 2020!
