🇵🇱 MAIN LEGAL CHANGES FOR FOREIGNERS IN POLAND – FROM JUNE & JULY 2025! 🇵🇱

Your life and work in Poland may change soon. Starting June 1, a new law is in force, bringing huge updates to residence and employment rules for foreigners. Another wave of changes comes July 1.

Here's a simple breakdown of what’s new – both the good and the bad.

✅ WHAT GOT BETTER?

🔹 You can now open a sole proprietorship (JDG) if you have a Blue Card!
🔹 More rights for Blue Card holders across the EU – including short- and long-term mobility.
🔹 No more "Labour Market Test"! Each region (voivodeship) will now have its own list of protected professions that are off-limits for foreigners – no nationwide test required.
🔹 Easier to change employers if you’re on a Blue Card.

⚠️ WHAT GOT TOUGHER?

🔻 Much higher fines for employers & workers:
• Employers: up to 50,000 PLN for illegal employment
• Foreigners: fines from 1,000 PLN to 5,000 PLN for illegal work

🔻 Stricter rules for student visa holders:
If you're on a student visa, you can’t apply for temporary residence & work, and you can’t open a business without special permission.

🔻Limited work rights on some visa types:
You cannot legally work in Poland on:
• Schengen visas from other countries
• Transit visas
• Certain national visas (types 02, 11, 14, 23)

🔻New obligation for Ukrainians & their employers:
• You must notify your employer within 7 days after receiving your residence/work decision.
• Employers must also inform the Labor Office within 7 days of your starting work.

🗓 Coming July 1, 2025:

🗣️ Polish language exam required for long-term EU residency!
To apply for EU long-term resident status, you’ll need to prove your Polish language skills at B1 level.

🇵🇱 NEW RULES FOR UNIVERSITIES & INTERNATIONAL STUDENTS IN POLAND – FROM JULY 1, 2025 🇵🇱

Big changes are coming to the Polish immigration and education system starting July 1st.
These reforms aim to tighten control over foreign student admissions and eliminate abuse.

Here are the 5 most important updates you MUST know:

1️⃣ Strict licensing system for universities

Only accredited, verified institutions will be allowed to accept foreign students.

Universities must now prove:
• At least 5 years of experience in higher education
• No tax/social debt
• Financial and organizational stability

If an institution fails to meet these standards, authorities (Voivode, Border Guard) can ban them from enrolling foreign students.
This is a direct blow to "visa factories."

2️⃣ New grounds for refusal or withdrawal of student visas & permits

Officials now have much broader powers to refuse or cancel visas and residence permits. A permit or visa may be denied if:

• The school is seen as operating mainly to help foreigners enter or stay in Poland illegally
• You previously misused a visa issued for studies

This gives authorities wide discretion and could lead to more rejections.

3️⃣ Polish language certificate now required

To apply for a residence permit as a student, you'll now need a recognised Polish language certificate, even if you're attending a post-secondary (policealna) school. This is to prove you're prepared for studies in Polish.

4️⃣ Foreign student limit: max 50% per university

A new cap is being introduced: no more than 50% of students at any university can be foreigners. This is meant to encourage integration and limit commercial abuse of student admissions.

5️⃣ Visa priority for PhD students and researchers

Poland will now prioritise visas for doctoral candidates and academic researchers.
Faster processing, fewer formalities, and special legal protections.

In our last post, we shared that holders of the Blue Card can now legally open a sole proprietorship (JDG) in Poland.

But what exactly is allowed — and what isn’t?
Here are 5 key answers you need before making a move

1. If Blue Card issued before June 2025, can I stil open JDG in Poland?

Your status is still valid for running JDG. The date doesn’t matter — what matters is that it was issued under Art. 127.

2. Can I invoice my current employer?

No, you cannot invoice a company where you’re currently employed under a job contract.

3. Can I offer the same services you do in your job?

Yes, you can — but only to different clients. You can’t replicate your current job under JDG.

4. Can my JDG income exceed your salary?

Yes, it can. There’s no income cap. You can earn more through your business than via employment.

5. What if my Blue Card expires?

You must suspend your JDG unless you receive another residence permit that allows business activity.

VAT exemption limit will increase to 240,000 PLN!

Good news for sole proprietors (JDG) in Poland!
Starting January 1st, 2026, the VAT exemption threshold will be increased from 200,000 PLN to 240,000 PLN.

If your revenue stays below this new limit, you can continue to run your business without VAT registration – that means simpler accounting and fewer formalities.

This change was officially signed into law on July 3rd, 2025, and will apply automatically from the beginning of next year.

💡 Example:
If in 2025 your revenue is, for example, 215,000 PLN — you will still qualify for VAT exemption in 2026!

❗️IMPORTANT ❗️

As of August 25, 2025, the President of Poland has rejected the draft law that would have extended the special law for Ukrainians until March 2026. At this moment, the special law remains in force only until September 30, 2025.

Therefore, foreigners who are working in Poland or running a sole proprietorship (JDG) should seriously consider applying for a residence permit (karta pobytu) to secure their legal stay and work in Poland beyond that date.

NEW DRAFT LAW FOR UKRAINIANS IN POLAND

📌 Disclaimer: This is only a draft law. It has not yet been adopted. The rules described below may still change during the legislative process.

Residence
Status under the Special Act will be extended until 4.03.2026. If the law is not adopted – the right to stay and work may expire on 30.09.2025.

❗Recommendation - apply for a karta pobytu (residence card) before the end of September to avoid the risk of illegal stay.

800+ child benefit
From 1.12.2025 may be available only if:
– the child lives and studies in Poland;
– the parent works or runs a sole proprietorship (JDG) and pays ZUS contributions (≥50% of minimum wage).
If not working – benefit may be lost.

Healthcare
From 1.11.2025 healthcare access only if contributions are paid. Free medical care – only in exceptional cases (e.g. war victims).

Polish Citizenship
Previously – after 3 years.
Now – at least 10 years of uninterrupted residence, and only with: permanent residence (stały pobyt) / EU long-term resident status / right of permanent residence.

Legal Stay for Ukrainians in Poland Extended Until March 2026

The President of Poland has signed a law extending the legal stay of Ukrainians who arrived in Poland due to the war until March 4, 2026. This decision ensures that nearly 1 million Ukrainians will have their residency status regulated and can continue to stay legally in Poland.

❗️Although your legal stay has been extended, applying for your Residence Card (Karta Pobytu) is essential to ensure you’re properly insured and fully protected❗️

Additional Key Changes:

🔹Employment requirement for benefits: foreigners from third countries will only be eligible for social benefits if they are actively employed in Poland or if their children attend school (children under 6 are exempt).

🔹Minimum wage rule: to qualify for benefits, foreigners must earn at least 50% of the minimum wage, which in 2025 is 2,333 PLN gross per month.

🔹Verification process: applicants must have a PESEL number and appear in person at the office with their children to verify their identity.

🔹Monitoring: ZUS will check monthly whether foreigners are legally employed and residing in Poland, using data from Border Guard and other authorities.

📌Personal submission of residence applications is unavailable

Since 7 November 2025, the Mazowieckie Immigration Office has disabled all appointment bookings in the inPOL system (temporary & permanent residence, family forms). This is due to planned changes to the Immigration Act coming in January 2026.

How to submit your application now:

Applications must be submitted after completing the MOS form: https://www.mos.cudzoziemcy.gov.pl/

You can submit your documents:
- by Poczta Polska;
- via Biuro Podawcze at pl. Bankowy 3/5 or Marszałkowska 3/5.

❗️Option with biuro podawcze works the same as post but takes more time to book an appointment.

What will change in 2026

All residence applications will need to be submitted electronically via MOS.
You can still use a legal representative (pełnomocnik).

What can I do now?

– Create Profil Zaufany
– Set up e-Doręczenia for communication with the office

🇵🇱 Changes to mObywatel & Profil Zaufany: What foreigners should know

Poland is introducing a new digital identification system starting 12 January 2026.

Here is the most important part:

What changes?

Polish citizens will soon log in to mObywatel and Profil Zaufany using the new e-ID (e-dowód).

What about foreigners?

Nothing major changes for foreigners.
As most foreigners cannot receive an e-dowód:

🔹 Profil Zaufany will remain available
🔹 Access to ePUAP, tax services, ZUS, CEIDG etc. stays the same
🔹 Other login methods will remain (bank login, password+SMS, app confirmation)
🔹 Your current PZ will continue to work

Poland cannot require a document that foreigners cannot legally have.

What should you do now?

✔️ Make sure your Profil Zaufany is active
✔️ Update the mObywatel app
✔️ Check your phone number & email

No additional steps are required.

We are monitoring the updates and will inform you as soon as the government publishes detailed login rules for foreigners.
