Criminal Special Leave Petition – Supreme Court of India (June 5, 2025)

Bench: Justice Ahsanuddin Amanullah and Justice SVN Bhatti

Key Highlights:

🔹The Supreme Court raised concern over out-of-turn submissions by multiple counsels during a hearing.

🔹The case involved a challenge to a Calcutta High Court order denying custody of a vehicle linked to alleged illegal betel nut trade.

🔹Justice Bhatti noted: “Which voice do we catch? I’ve seen more damage happen this way than help.”

🔹The Court stressed such disorder is uncommon in High Courts and should be avoided in the Supreme Court.

🔹After an apology, the bench accepted the explanation and remarked: “Sometimes we also get irritated.”

The Court stayed the High Court’s order and issued notice in the matter.

Case Title: AS v. State of Haryana, W.P. (Crl.) No. 235/2025

🔹 A woman lawyer alleges sexual assault and illegal detention by Gurugram police officials when she visited Sector 50 police station with a client.

🔹 Claims male and female officers manhandled her, and tried to force her to consume a suspicious liquid.

🔹 No arrest memo or MLC was provided; family was not informed — violating DK Basu guidelines.

🔹 She filed FIRs in Delhi and Haryana; in return, Gurugram police also filed an FIR against her.
🔹 Demands from SC:

Transfer and clubbing of FIRs to CBI or Delhi Police

Disciplinary action against officers

Protection from further harassment
🔹 Supreme Court asked her lawyer to approach the CJM for a copy of the FIR; next hearing scheduled for the following day.
🔹 Case highlights serious concerns on gender-based targeting, abuse of power, and violation of fundamental rights under Articles 14, 19, 21, and 22.
