Case Title: Sachin vs State of Maharashtra | D No. 24169/2025
On May 26, 2025, the Supreme Court of India dismissed a Special Leave Petition seeking a reduction of the 20-year rigorous imprisonment awarded to a 23-year-old convict under Section 6 of the POCSO Act for the aggravated sexual assault of a 6-year-old girl.
A bench comprising Justice BV Nagarathna and Justice Satish Chandra Sharma held that:
🔹The punishment awarded is statutorily mandated under the 2019 amendment to Section 6 of the POCSO Act, and cannot be reduced by invoking inherent powers.
🔹There were no extraordinary circumstances justifying a lesser sentence.
🔹The plea of juvenility was rightly rejected, as the convict was found to be above 18 years at the time of the offence.
The Court reaffirmed that minimum sentences under the POCSO Act are binding and not subject to judicial discretion.
The Court emphasized the heinous nature of the crime, and upheld the Bombay High Court’s order dated January 8, 2024.
