Article 143(1) Presidential Reference

Case Title: Presidential Reference on Governor’s Powers to Withhold Bills – Article 143(1)

🔑 What’s the issue?
The President has invoked Article 143(1) to ask the Supreme Court 14 questions about the powers of Governors and the President regarding Bills — an unusual move, especially since these issues were already decided in the State of Tamil Nadu vs Governor case.

⚖️ What is Article 143(1)?
It allows the President to seek the Supreme Court’s advisory opinion on important legal questions but the Court is not bound to respond, and the opinion is not binding.

💥 Why the controversy?

🔹The Supreme Court already settled the issue in the TN case.

🔹This new Reference is seen by many as a political move or an indirect attempt to review the earlier verdict.

🔹Past rulings (Cauvery Reference, 2G Case) say Article 143 can’t override or appeal final SC judgments — though clarifications are allowed.
