🧑‍⚖️ SC: Bail Should Be the Norm Under Section 132 of CGST Act

Case Title: Vineet Jain vs Union of India
Bench: Justice Abhay S. Oka & Justice Ujjal Bhuyan

📌 Summary:
The Supreme Court granted bail to an accused under Section 132(1)(c), (f), and (h) of the CGST Act, 2017, observing that bail should normally be granted in such cases unless extraordinary circumstances exist.

Key Points:

🔹The accused had already been in custody for nearly 7 months.

🔹The charges were bailable in nature (max punishment: 5 years with fine).

🔹Evidence was documentary, and the accused had no criminal antecedents.

🔹SC expressed surprise that both the Magistrate and High Court denied bail, forcing the petitioner to approach the apex court.

🟢 Outcome: Bail granted; High Court order set aside.

⚖️ Takeaway: In CGST offences where evidence is documentary and there’s no prior record, bail should be the default, not the exception.

4. SC earlier stayed the High Court judgment and agreed to hear the matter.

5. Hearing was adjourned to May 7, 2025, due to court time constraints.

6. Another similar petition by a different candidate was mentioned today for joint hearing.

7. The Court is yet to deliver a final verdict; current status: adjourned.
