Issue:
The Supreme Court addressed whether a High Court can reject a plaint under its supervisory jurisdiction under Article 227 of the Constitution.
Ruling:
🔹The Supreme Court ruled that a High Court cannot reject a plaint using its supervisory powers under Article 227.
🔹The Court emphasized that this power is supervisory and cannot be used to usurp the trial court's jurisdiction.
🔹The Civil Procedure Code (CPC) specifies the conditions under which a plaint can be rejected, and such decisions can be appealed under Section 96 of the CPC.
Conclusion:
The Supreme Court set aside the Madras High Court's decision, reinforcing that the supervisory jurisdiction under Article 227 should not be used to bypass legal procedures.
