SC Overturns Death Penalty in Minor Rape-Murder Case Due to Flawed Trial & Mishandled Evidence ⚖️
The Supreme Court has acquitted Karandeep Sharma, who was earlier sentenced to death for the rape and murder of a minor, citing serious legal lapses in the trial. The Court slammed the trial judge for illegally allowing the investigating officer to narrate the accused's confession—violating the Indian Evidence Act and CrPC, which require confessions to be recorded by a magistrate.
The prosecution also failed to produce the DNA expert in court, making the forensic report inadmissible. Additionally, the chain of custody for the DNA samples was not proven, raising concerns about tampering.
Calling the trial “distorted and lopsided,” the bench set aside the conviction, stressing that due process must be upheld—especially in death penalty cases.

Court's Emphasis on Urgency: The bench, comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela, stressed the need for a swift resolution to alleviate the anxiety of undergraduate aspirants.
Consortium's Defense: Senior Advocate Rajshekhar Rao, representing the Consortium of National Law Universities (NLUs), argued that judicial intervention is appropriate only when answers are "palpably," "demonstrably," and "ex facie wrong."
Court's Recommendation: The court suggested that the Consortium appoint more competent paper setters in the future to prevent discrepancies.
Next Hearing Scheduled: The hearing remains inconclusive and is set to continue tomorrow, April 9, 2025.
