The Supreme Court quashed criminal proceedings against badminton players Lakshya Sen, Chirag Sen, their parents, and coach U. Vimal Kumar, accused of fabricating age records for U-13 and U-15 tournaments.
The FIR under Sections 420, 468, 471 IPC was based on a sole 1996 GPF form, lacking authentication and evidentiary value.
The Court found:
No prima facie offence or fraudulent intent.
No forged document used knowingly.
Complaint motivated by personal vendetta after complainant’s daughter was denied admission to Prakash Padukone Academy.
SAI had closed the matter after bone and dental tests at AIIMS Delhi confirmed age.
Quoting Pepsi Foods Ltd. (1998), the Court said misuse of criminal law for collateral purposes is unacceptable.
The Court allowed the appeal, holding the allegations false, baseless, and an abuse of process.
